If your mother can show enough income for you, your three kids, and your boyfriend, plus herself and anyone else living in her household, then yes, you can apply for the K-1.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Actually, she could petition for her fiance. She can do nothing for a boyfriend. No financials are included with the petition. Once the petition is approved, the "fiance" not "boyfriend" will be invited to apply for a visa. It is at that time, the financial documents are used. Whether the fiance's visa application will be approved will depend on a number of things but as far as the financial aspects, yes a qualified co-sponsor is generally sufficient. The co-sponsor would need $32,237.50 in income for a household of 5. That's a minimum of mom, three kids and the fiance.

Please note there are for generally recognized levels of fraud incidents at US Consulates abroad. From lowest to highest, they are:

1. Low

2. Medium

3. High

4. Lagos Nigeria.

You can petition for him no problem. Whether or not he will be able to get a visa depends on you finding a co-sponsor with a high enough income.

I get emails all the time from people with lots of money in Nigeria.

Even job offers, all I need to do is send a small processing fee.

WOW. Be careful. Yes you can petition for your fiance. There is no financial information with the petition, and they have already noted how your mother can do this and what her qualifications must be. I repeat, be careful

you also need to understand that there a A LOT of expenses with filling a petition, to file the petition it is 455, (this not include all the money spend photo copying, gather evidence (copy of birth cer., pictures, ext), then there is the interview fee 131.00, plus medical (hopefully if he really is rich he will be paying for this, but most of us with African fiancés have had to help at least a little with this). Then airfare (a one way ticket from Africa is almost as expensive as a round trip) and finally adjustment of status which is over 1,000.00. If you are struggling for money now, you really need to be aware of how expensive this all gets. I am struggling to make it, and I work full time and have no kids.

Unfortunately this immigration process is not made easy or cheep, so if you are poor it is really hard to do.

You also should look in the regional sub Sahara form, the people there are pretty honest, and you will hear the successful stories of those marrying an African and also the stories of fraud.

Also, the Lagos embassy is one of the hardest to go through; it is a very long process for most.

One more thing is even if your fiancé is has a lot of money there, his economic status might change in the US. Most schooling or job experience will pretty much count for nothing here, and will probably have to take a job he would consider to be menial in Nigeria. He will probably not be making the same competitively, especially when things are so expensive here.

PS. Don't take my word on any of the price quotes, they could be more now, ready the guides, do the research, so you know what you will be getting yourself into.

You're going to want to check with the folks in the Sub-Saharan Regional forum here on VJ in regards to being introduced by a relative.... I'm not sure if it matters in Nigeria but it may be a big red flag that you will need to prepare for.

why does this thread remind me of someone asking for my bank account number to help them "save" money?
