I-130 for unmarried child over 21

my grandmom petitioned my aunt 16 years ago and after such long time,her case was at NVC now..

-she was single when my grandma petitioned her but shes married now, will it affect her case? or can she just change status?

-how about her kids?can she take them?or they should be petition also?

02/16/12 - mailed I-130

02/27/12 - NOA1 petition received(hubby's birthday!)

06/06/12 - NOA2 stating I-130 approved

06/29/12 - NVC received case

07/09/12 - case entered in the system,assigned MNL # and IIN,email add given

07/12/12 - beneficiary emailed DS-3032, auto response received

07/18/12 - AOS fee bill/paid "IN PROCESS"

07/20/12 - AOS fee bill shows "PAID", mailed AOS package

07/25/12 - received AOS

07/25/12 - IV Fee Bill Invoiced, paid $230.00 "IN PROCESS"

07/26/12 - IV Fee bill shows "PAID"

07/28/12 - mailed IV Package

08/03/12 - received DS 230 packet

08/14/12 - sent RFE

08/16/12 - NVC received RFE

08/21/12 - log in failed

08/22/12 - case complete!

09/26-27/12 - medical at SLMC

10/04/12 - interview

12/01/12 - Left Philippines

Was your grandmother a US citizen when she petitioned for your aunt in 1993? If not, when did she become a USC. (I know she is a USC now.)

When did your aunt get married?

If your aunt got married before your grandmother became a USC, then your aunt's petitioned will be denied as there is no means for a LPR to petition for a married child. Your aunt's petition will get denied if this is the case.

If your aunt got married after your grandmother became a USC, then your aunt's petition is still good and she will be moved from the F1 family immigration category to the F3 family category. Your aunt or grandmother needs to write to the USCIS and National Visa Center (NVC) that your aunt is now married and she has children who she wants to be derivative beneficiaries; include English translations of the marriage certificate and birth certificates for the children. Your aunt's husband and children under 21 years of age will be able to get to immigrate with your aunt.

Currently, immigration visas are available for F1 Filipinos, UCS petition for unmarried child with priority dates before July 15, 1993 and for F3 Fiipinos, USC petition for married child, with priority dates before June 8, 1991.
