Hi, I was just curious. I'm finally getting ready to file my K-1 visa. I pretty well know the ins and outs of the process. The only issue I can see is with the current economic trend I mite lose my job. What would happen if I filed my forms with proof of employment which is correct at the time and the immigration is excepted for processing then I lose my job. Would I need to resubmit information ?

Any information is welcome.

Financials are not filed with the petition. They come later at interview time and should be as current as practical at the time of the interview. Once the affidavit is executed, if something changes, it changes.

Facts are cheap...knowing how to use them is precious...

So after the affidavit is executed you could lose your job and it wont cause any issues, besides personal issues of feeding the wife hehe? :blush:

I didn't say that and wouldn't say it because I don't know what questions will be asked during the interview. The applicant could be directly asked, "Does your fiance still work at XYZ company?" to which you would not want her to answer untruthfully.

Gotcha. Thats a huge help! Argh, nerves are finally getting to me! After 3 years I finally get down to business. I have all my proofs of income, proofs of relationship, proofs of support, birth certificates and so on established for well over a year now. After several trips to be with her family for prolonged periods of time... its about time! Now comes the fun part! Actually Im not terribly impressed by the difficulty of these forms. Nor handling the filing process. I'm more worried with being able to continue working for the company I am in so as to show the immigration I am a good supportive husband. Sigh, bad timing to have a recession. :blink:

Probably be back in a month when alls going forward with the process. Until then wish be good fortune :innocent:

Pushbrk gives good answers. True, you do not file financial information with the petition. Yes, the situation he suggests could arise at the interview, though probably not likely between creating the I-134 and the interview which should be a very brief period, but then there is also the AOS after she arrives and you have to do it all again within 90 days of her arrival. That would NOT be a good time to lose your job and it very well could cause problems other than feeding the wife.

I would also suggest you do not depart from VJ for a month, but read the forums, guidelines etc. as you go about filling out the forms. You are correct, it is not rocket science or even brain surgery, but read the forums and you will see how many people have rpoblems that were not terribly impressed with the difficulty of the forms. You had already made the error of believing you needed to send finacial documents with the petition. That wouldn't cause a problem, just a waste of time, but it is something you clearly didn't understand. The next thing you don't understand will get you an RFE or add many weeks to your process.

I only encourage you to take advantage of all the great members here helping you out.

Thank you for your blunt response. In actuality I'll be studying for a very long time. There are many processes I understand due to being around to help a friend with his successful immigration. Some I obviously don't. As for filing the wrong papers such as the income proofs, that was more a mistake of phrasing on my part. I won't simply be doing ANY of the steps by the seat of my pants. :no:

As for my income, I am hopeful if I lose my job that I can get a similar one within 2 weeks. Its just nerve wracking thinking about a change of venues after 10 years.

There is nothing in the rules/laws that state that. Where did you hear about this?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

There is nothing in the rules/laws that state that. Where did you hear about this?

I have a friend that was going to try to go thru the K-1 visa process and went to an immigration attorney. He told her about the large savings amount that the foreign fiancee must have so she is getting married and then applying for the K-3 instead. I was just wanting to know if that was true. I have never heard that. My fiancee does not have the $10,000 pounds in the bank that she mentioned. I don't want to get denied because he does not have that kind of money in the bank. He lives in England and we are anxious to start the visa journey but don't want to get held up because of that. Any help anyone can give us would be great. This forum has been a great help to us.

You don't need ANY savings if income is sufficient.

Immigration attorneys often know little to nothing about immigration. He was probably concerned about getting his considerable fee to do basically nothing. Keep your money, file yourself. If your friend made a judgment on this erroneous advice I hope she is happy with it. If her fiance has income over and above the poverty guidelines he does not need even $1 in savings.
