why would you say anything, though? Purpose of visit: holiday. Just visit and be merry!

As a Canadian citizen, you're allowed up to 180 days of vacation time in the US.

Well, I am now unsure what to do at this point. State I am going in to see my fiancee or not? I thought we were supposed to be 100% honest (within reason) and not hide anything, ever? That said since we are mailing the petition out so close to my visit (approximately 14 days before I enter) maybe it is best I just say I am going in on vacation and keep it simple this time? Good or bad idea?

I am aware of our allotted vacation time allowance in the US. I have never had any problems at the US border, but it also will only be 2 months since my last trip down.

???

What we have decided to do is mail the I-129F petition on lucky Friday March 13th and when I enter a week later on March 20th just state I am going down for vacation and leave out any mention of "fiancee" at this point. Thoughts and advice is highly appreciated.

Thanks in advance,

Sounds good. Think of it this way (plagiarized). It is no less honest to fail to mention visiting a fiance than it is to fail to mention that you will visit a pubic library. A general but truthful answer to "Purpose of visit?" is fine. Having evidence of ties with you just in case is a really good idea though.

Facts are cheap...knowing how to use them is precious...

Ive also wondered this when we come to submit our K1. Would they have any knowledge of my K1 application at the POE, if so Im guessing that saying im visiting my girlfriend, rather than my fiancee woulden't go down too well? I last visited her 2 weeks ago and just told them I was visiting my girlfriend, he asked about where I met her etc, but was all very friendly and was on my way within a minute.

I guess it depends how good you are at omitting details?

Perhaps you should answer with whatever answer you are most comfortable with. Do you think omitting that you are visiting your fiance' is - not telling the truth?

If so, then you will probably look like you are lying and you will get asked more questions and - well and then what?

Think of it this way - you can take all your ties to Canada with you and a copy of your I-130, tell them you are going to visit your fiance' and if they ask for your proof of ties, you are good.

Tell them you are going for a vacation, if they question you further - you will probably have to mention your fiance' - how is that going to look? You don't want to make them mad - they are very unpleasant when they are mad.

Our issue with delaying the petition and leaving out the Fiancee part is that at present I actually do not have very strong ties to Canada. (See my earlier posts in this thread.)

Thanks for your advice everyone,

Not having strong ties can hurt you whether you have a US fiance, or not. Bring anything you can think of to tie you to home.

I'm sure you will be doing lots of things on your visit... not just visiting your fiance. You know you're not going with the intent to immigrate so why mention something that will surely throw up some red flags? You can be honest without giving them your life story, you know?

If they ask you specific questions...that's a different story. Misrepresentation is a much bigger problem than simply being allowed to withdraw your petition to enter. ;)

They will have no record of your K-1 unless you tell them.

Hey guys,

No problems with me entering the US on the 13th, I did not mention my fiancee or the petition and they did not ask any details, Customs took about 15 secs. We received our NOA1 today in the mail, very cool to receive it while we are together here. Only one small error, they screwed up my name and gave me a middle initial (N.) when I have No Middle Name. (Which is what we wrote on the forms: No Middle Name, not N/A or None.) ??? I will have to call the 800 # they give to correct that ASAP.

So I guess we can start our Timeline now... I'll look at starting that soon. The countdown to NOA2 is on!

We have almost the same timeline and we live in the same places lol! I live in Florida and he lives in Ontario!

My fiance is coming to visit me in two weeks, but he is flying so I think a return ticket should be sufficient evidence of his intent to go home!

Sometimes a return ticket is not enough. All depends on the Border Guard you have that day and their mood.

You might want to tell your Fiance to bring some back up proof of his ties to Canada, just in case. No harm in packing along a few extra pieces of paper to ensure he will make it down there.

So I guess my suggestion is....never assume a return ticket is enough....always have back up proof, it would suck to be denied a trip because you had no other proof that he was actually coming back home.

Over Christmas I went with my Fiancee to Victoria for a few days. We drove up from Seattle and took the Ferry from Port Angelese Washington to Victoria. On the way home, heading back into the US, they made me (Canadian Citizen) go through extra clearance through Customs. I had to show my return ticket for my flight home from Seattle to Calgary....luckily I had that document packed in my suitcase I brought, otherwise I would have been stuck in Victoria and not allowed back into the US.

So over pack your proof and have it with you just in case, never know when they are going to crack down and ask you to show it. Most of the time crossing the border is a breeze, and other times they are sticky.

Cool! I just did our Timeline and our I-129F may be adjudicated between July 24, 2009 and August 6, 2009. Which is about the dates we figured and are hoping on....

Based on what I have been reading here your fiance had better bring more strong ties to Canada than just a return ticket for his next trip. I have been assembling a fair bit of evidence for my May trip as I will be stating I am coming down to see my fiancee then.

Good luck, keep us posted of your progress.

We are both thinking positively and hope that things will go as planned and judging by average timelines I will hopefully receive the K1 Visa by September/October. We plan to get married on Siesta Key this Fall, and almost all of our families will be in attendance.

I know this isn't the purpose of your thread here, but... Just thought I would point out that there's still quite a bit of waiting between NOA2 and POE, especially if your SO will be interviewing in Montreal. Here are some helpful links to give you an idea:

http://www.visajourney.com/consulates/inde...mp;cty=Montreal

According to this, the approximate wait time between Packet 3 being sent back and interview is 4 to 6 months.

Best of luck to you!

Can someone please explain to me how this is a problem? I flew to Canada just last month. He has flown to see me 5 other times. All that happens at the airport is they check your passport. Is there some database that they scan your passport against that notifies them of our I-129f? I just received my NOA1 last Friday, and he is coming in less than two weeks for Spring break.

I don't see why he should bring any extra papers or request a letter from him employer. As far as I know our file is sitting in Vermont for the next 130 days or whatever until they approve it and send it on.

He is taking classes in college that aren't over yet, so that's a reason to return. He also works as an accountant and Canadian taxes are due by the end of April so he has a lot of work to return to. I don't want him to have to request a letter from his employer, because then they will know that we are engaged and then they might surmise that he is leaving. He is close to getting a raise and he doesn't want to lose it because who knows how much longer he will be in Canada until this is all approved?

For a Canadian, traveling to the U.S. is usually hassle-free but not always. The point is that you need to provide proof of ties if requested by the CBP Officer. Simply saying, "Yes, I have a job that I intend to return to and I am a student" is usually enough, but not always, and does not really prove anything.

Maybe he could bring along a class syllabus showing his final exam dates. I just don't want to have to involve his employer.
