Hi Everyone, didn't know exactly where to post this, but here's the question.

My fiance and I are waiting for our K-1 Visa to be approved (aren't we all..) and I am in the U.S. Navy. I get out of the Navy in November this year (2009), and want to change my state of residence from South Carolina to California (where I've been stationed for the past 5 years). The quickest and easiest way to change residency is while I'm still in the military, and I'm wondering when I should do it.

We probably have another 6 months before my fiance gets here, and I'm wondering if he automatically will get residency of the state that's been on all our forms for the K-1, or if the marriage certificate (depending on which state issues it) determine's his residency?

Also, of course, when should I change residency? I have about 9 months till I'm out of military, probably about 2 months until our NOA2, 6 months or so until he's able to come to the states and get married (hopefully). Should I just wait until we are married or change before?

haha, sorry, just confused... thanks for any help you can give!!

Well, nothing in this process is "automatic" and state residency is really a very nebulous thing. what ever state you end up living in , your fiance will establish residency bu obtaining a drivers license or state issued ID card. In Vermont it went like this...

Fiancee arrived

Went for SSN next day

Got SSN, went to bank and added her to account (needed SSN for this)

Got married

Filed for AOS

Took marriage license, bank statement, SSN and I-797C (Noa1 for Adjustment) to the DMV and she got a drivers permit, establishing her as a resident of Vermont.

2 months later she got her drivers license.

All of this USCIS stuff, is Federal, it does not establish residency in any state, you do that yourselves later.

i would say if your filling out a form today the answer would be where u reside as its obvious they would be with u, this can change at any time later as u change

Wow, thanks everybody! I didn't get a notification that anyone had responded, so I didn't know :)

Well, all this information is comforting, and I guess the only question I have is that, on all my K-1 documents (which I've already submitted a while ago) say that I'm a South Carolina resident (even my application went to the Vermont Service Center instead of the California Service Center).

So if I change my residency in the middle of the process, will that delay me or cause complications with our visa process as it is, ongoing?
