Hi Everyone,

I have been reading here for a few weeks and decided it was time to post. I am assembling all the information needed for the K1 to get my fiancee here from Australia. The paperwork seems pretty straightforward, the timelines a little depressing but manageable. My first question, of probably many

to come, is: Our plan as a couple is for her to go to school here, ideally starting fall of 09. I want to get her in school, in the country on a student visa, but also do the K1 too. We have already acceptedthat we may have t ojust d othe K1 and sit tight, but it sure would be nice if she could knock out her first semester of school while we wait for the gears to turn with the paperwork. Has anyone done this? it might mean we would both be here, with her in school, and she would possibly interview here, in the US?

You might want to adjust your plan to look at spring semester '10. She really can't have two visas at once. With a bit of luck, she might be here by September with her K-1 if you file right away.

I would just file for the K-1 as soon as possible. Likely she would not begin school in September, but possible. I filed last March and my fiancee arrived in September and she could have been here mid august but for our own schedules. But our case went remarkably fast, so I wouldn't count on it.

As far as attending school, there is no problem in most cases. My wife began classes about 10 days after arriving, she needed only to show she was legally in this country and had a SSN which we applied for the day after she arrived. We had all her classes and things arranged before she arrived and she was even tentatively enrolled, she had only to bring her passport, I-94 and SSN to get started in classes.
