Is it possible to have K3 first then CR-1

Hi all,

Hope everyone is having a good weekend so far! I did some research on my question but was unable to find a concrete answer for it. The NVC has already approved our K3 and was forwarded to the Finnish embassy sometime this week. Yesterday, I have just paid our AOS fee and confirmed NVC has received our DC3032.

So, here is my question. How can I continue in the process of I-130 with this K3 visa being approved? We would rather choice I-130 over K3. So, can we just ignore the K3 or just continue with it?

I think I figured it out but would be great to get some confirmations. So I guess we can ignore scheduling the interview for the K3? or is it better to tell the Embassy first we rather continue with I-130 instead.

Yes, you can continue the CR1 path regardless but you do not haved a K3 visa approved. You have an I-129F for spouse petition approved. The visa is approved during or after a visa interview.

Yes, you can continue the CR1 path regardless but you do not haved a K3 visa approved. You have an I-129F for spouse petition approved. The visa is approved during or after a visa interview.

Don't mind pushbrk. He splits hairs. Knows what he's talking about [most of the time] tho.

VERY good decision staying with the CR-1.

Some peeps reschedule their K3 interview until the I-130 catches up. Normally they'll just give you one interview for the CR-1 then.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

This particular hair split is quite cogent to the case at hand, as most are. This one actually is more like splitting a stump. An approved petition is not an approved visa in the same way a stump is not kindling. In case you haven't noticed, the devil is in the details here and the OP is asking about details.

Hey thanks for the quick replieds. There is one question that I'm kind of confused with, I heard there are other payment associated when my wife is having the interview (either I-129F or I-130)? I have no idea where I heard that one from, but hopefully someone can clear it up for me.

Yes, there are later fees. For the K3, she pays $131 visa fee and perhaps a small delivery fee, (either visa) then after arrival you pay $1010 to adjust status.

On the CR1 side, you pay NVC a $400 visa fee and a $70 (or is it 80 now?) Affidavit of Support fee. 21 months after entry on a CR1 you pay around $500 to remove the conditions (the C in CR1) on her permanent resident status.
