All,

Is this what I think it is ????? I got this letter in the mail today (I didn't check the mail box yesterday). Do you think we are out of Administrative Processing already ????????

-------------------------------------------

February 19,2009

Dear Petitioner:

The State Department's National Visa Center has recently received an approved I-129F petition filed on behalf of your finacee'. This letter is to let you know that within a week the petition will be forwared to the appropriate visa-issuing post where your visa interview will take place.

Our records show that you filed the I-129F petition for:

Name of Fiance': NADIYA

INS Receipt Number: EAC08244*****

Case Number: KEV2009******

The case will be processed at:

Post: KYIV

EMBASSY OF THE UNITED STATES CONS

6 PIMONENKO STREET

KYIV, 01901

UKRAINE

Your finace' will soon receive a packet with instructions from the consular section on how to apply for the K1 visa at that post and what documents will be required. In the meantime, you should visit the Department of State's website at www.travel.state.gov/visa/immigrants/types/types_4323.html to determine if the processing has any information of which you should be immediately aware.

Sincerely,

Bereau of Consular Affairs

-------------------------------

Well, Im sorry to say that I received 4 letters like that with all different dates and when i called they said we were in AP. I think that letter is generated as soon as the file is entered into the nvc system.

You should still call to check, but im afraid they will say you are still in AP. :(

For your other question...I THINK it woudl be a rarity for NVC to find some reason to deny the petition after AP. Maybe if they found something wrong with your documents or something on the background checks that you didnt disclose...im just speculating though.

good luck

"you fondle my trigger then you blame my gun"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

NVC cannot deny a K1 after approval. Once they get done mucking around they send it to the consulate. Approval or denial following interview happens there. So far, any of us in the main thread on K1's delayed at NVC who were released and sent on have had a successful interview.

I can explain it to you. But I can't understand it for you.

I believe that I have read that NVC can send a case back to USCIS if there is a problem with a name check or something. I will defer to VJers with longer tenure than mine, but I seem to remember reading about a case that was returned because of a name problem or incomplete file. I agree that it is rare though.

that's why we hired a lawyer to avoid such little problems as mistakes in filling. We didn't talk to our lawyer yet and we wait what he will tell us WHY?

And Brad, you told before that someday Vika and you will go to Turkey :) It's a good idea  last summer we have planned it too but because of our little son we delayed it.. About western part of Ukraine, well, the best visiting time is winter because there is a wonderful place for skiing or in summer just make a tour of ancient cities. But I prefer the first

Cool. We went to Lviv in June, and had a week scheduled in Uzlissya resort. Vika got sick and we just stayed in Lviv. A great trip. We really wanted to visit Antalya in January too, but with Vika leaving for the US and all, her family needed the time.

k-3's at VErmont were and are taking at least 7-9 months for approvals. Funny how geographics make such a big difference.

I wont start my CSC vs VSC rant now heh heh

Our whole process will easily drag out to the year mark by the time he gets his interview.

Well, Im sorry to say that I received 4 letters like that with all different dates and when i called they said we were in AP. I think that letter is generated as soon as the file is entered into the nvc system.

You should still call to check, but im afraid they will say you are still in AP. :(

For your other question...I THINK it woudl be a rarity for NVC to find some reason to deny the petition after AP. Maybe if they found something wrong with your documents or something on the background checks that you didnt disclose...im just speculating though.

good luck

are you still in AP too since 5th Jan??????

yes, and thats after an over 8 month wait at VSC. :crying:

Ouch!! Any explanation at all as to why?

k-3's at VErmont were and are taking at least 7-9 months for approvals. Funny how geographics make such a big difference.

I wont start my CSC vs VSC rant now heh heh

Our whole process will easily drag out to the year mark by the time he gets his interview.

Sorry to hear it. I should have noticed the K-3. It reminds me how good K-1s have it sometimes. It always surprises me when some one posts a question asking if the K-1 or K-3 is better, like they will time the marraige based on the visa timing. I point out the timeline and USCIS disclosed timeframes in response. It must be even harder to wait after you are committed that way.

Thanks Brad.

Ya, some people so base their marriage decisions on the visa timing. If it works for them, thats cool I guess.

I realize this process is hard in any context, but we thought the k3 was supposed to be the fastest route for spouses and designed to unite families faster. not so much anymore. The CR1 is now faster at the service centers.

I just hope VSC speeds it up soon for future filers and no one else has to wait this long for their spouse.

now, I think I'll go call NVC and bug them :P

"you fondle my trigger then you blame my gun"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

I understand you.. we will go to my native town too, to visit my relatives before going to the US. But I think after marriage you can spend time on wonderful Miami beach ;) I am sure Vika will be happy to spend time there. About Antaliya, it's a good idea too, but since you have lived in the USA it will be easier to travel around USA than come back to Europe again. And Vika needs to get Advance Parol for traveling outside of the USA.

Antalya will be post-green card travel for sure. It is mostly me wanting to go there. I also want to see Istanbul, just to say I did it. Vika grew up next door, so Turkey just doesn't get her as excited.
