For those of you that cannot connect to Vermont, and are having difficulties, after you enter your case number you need to listen until close to the end before entering the next few digits. If you don't it does not work. So be patient.

I sent in my RFE today, because this goes to a totally different department than the RFE, so why wait for the RFE.

I just booked my flight to go see my love I am so excited right now, because I can't wait another 4 or 5 months for all of this processing.

Good Luck to us all, I can't wait for one of us to at least get an RFE from the recalled petitions. I have a feeling that the reason those with just NOA1's are getting them first is due to the fact that their petitions are still active there and accesible. Ours are probably in a huge stack somewhere. The faster they get the NOA1's out of the way the faster they get to us. I know it really frustrates me to see another RFE with a Receipt date months after mine, but we have no choice but to cheer them on and keep coming.

An idea I had, what if one of us who has had the RFE sent already, gets the RFE in the mail and makes an Adobe PDF copy of it so we could print it out and send it in ourselves? After all, it would still result to the same case# because we would be writing it in, and match the our cases as they recieve them. Logicaly, that sounds right.

Maybe it will remove some of the wait time for them to get to our case to send us the RFE because they would still have to process the mail the same way, right? We already know we are effected by the dates of our NOA1's. But we don't have to be beureaucratic patsies like they have to be and wait for "official" notification before we can "officialy" say our case has been recalled. It's kind of like helping them reduce a step or two by doing it for them, and by side efect will save them and us some time I think.

What do you all think? Would you May/Juner's be willing to do that when it comes in this week before you fill the form out?

Since we have to send the RFE back with whatever they ask in the RFE, that wouldnt´work ´cus how would you be sending back something they haven´t sent you yet?

I have to wonder, though, if this particular RFE isn't just a canned RFE. Because of the uniqueness and urgency of the situation, I would not be suprised if it's not a typical RFE at all and just a special temporary form with the background check questionaire on it.

It would be still good to see a PDF file of one to see if it could be workable.

Thats presuming they know that, that is the easier way. Which obviously because of what we are going through right now, they don't.

There is no reason what so ever that they MUST see our petition first before sending the RFE. Frankly, if it takes 3 months to go through 3000 peitions at the Philippines embasy, imagine how long it will take for the 10,000 to go through them all manualy. No, they are following beureaucratic procedure that is all. If the form is not pre-filled out, then as they recieve them they can find the case and attach it to it.

Well well I finally got through to VSC on my 4th try! And yes my case is back with them, thank goodness. This is good news for the Russia people. She didn't have a timeline for when the RFE's would go out but she DID recommend filing an expedite request. And since we haven't heard anything I'm going to do that at the end of the week if I don't get an email from them and let you know how it goes.

I sent one today; here is the template. Also include the State Dept. memo highlighted with the quotes from the letter. You may want to modify it according to your specific case:

To whom it may concern:

My name is xxxxx and my fiancée’s name is xxxxx. The purpose of this letter is to request expedition of our approved I-129F petition (receipt #) due to USCIS error. My fiancée was notified by the xxxxx consulate by phone that our approved petition was being returned for review to the USCIS.

I later discovered an unclassified memo released by the State Department (00077044) that states “Some petitions were approved in error under the old procedures and sent through the National Visa Center to posts for processing.” It logically follows that if the USCIS is responsible for approving I-129F petitions, then the USCIS is in error. The memo also states “The DHS Service Center Operations (SCOPS) Unit of USCIS, Status/Family Branch requested that posts return to NVC all K1 I-129F petitions with priority dates (date received at the DHS office) on or after March 6, 2006” which demonstrates USCIS error.

Our petition was one of the petitions that was caught up in this error. I have included all relevant documents to this matter in this mailing which include a copy of the approved I-797C, a copy of the notice of approval from the NVC, and a copy of the letter from the Ciudad Juarez consulate informing us that our case was ready to process. At no time was I or my fiancée informed by the USCIS that this recall process had begun. We had to find out through press releases and a phone call from the consulate. Therefore, I request an expedition of my petition due to USCIS error.

Hi everyone,

I'm pretty new to all of this so I'm still trying to figure out what all of the abbreviations mean! I sent in my application for an I-129F visa on May 2, 2006 and I recieved an email on Thursday, June 15 stating that a RFE was being mailed to me. I still haven't recieved it so I have no idea what it's about. After reading all these posts it seems like something is going on?

My interview has been cancelled by US embassy in Paris on May 15, 2006.

I don't know why they have returned my petition to US because my file isn't under IMBRA ;

NO2: March 9, 2006

Does any one have my situation?

Go to the Visa FAQ tab on top of the page and go to the appendix, you can find defined terms there. Your petition has been recalled due to IMBRA most likely, a new law that affects all I-129Fs for a K1 after a reciept date of March 6th 2006. It's actually a good thing you got notified that your RFE is on its way, many other people have not received this notice. I would suggest going to the thread "Vermont and RFE (involving IMBRA)" pages 4-5 and letting them know this info so they can add it to the list of the people that have received notification that the RFE is on the way.

As for IMBRA, well, there are many posts on this topic all over. When I first got started here, I read all of the guides and the FAQs first. Then IMBRA happened and all of us had to learn about this particular subject together.

There were some steps missing. Here is the correct sequence to get to Vermont. An aside - this is the most ridiculous system ever. Any other sequence take you to a set of operators in Las Angelas that know absolutely NOTHING
