I'm starting this thread to share info with people that had their I-129F approved and then sent back to the USCIS. My petition arrived back at Vermont on 06/12/06. I have not received any updates online since my petition was approved on 04/06/06.

Any additional comments or info would be appreciated.

Hello everyone, my fiance and I are but another victim of IMBA. I want to say that this is a great resource for info especially since the various agencies associated with this fall under, "the right hand doesn't know what the left hand is doing".

As we all know delivery and processing time vary between which service center is used, when you filed, and which embassy the petition was sent to. What I'm trying to see is if there is anyone out there who had a petition sent back from Manila and have received notification of it at least reaching their service center. In addition a timetable from anywhere would also be helpful just to get a guesstimate of what to expect. Maybe we're over-stressing for no reason.

Our timetable is as follows:

NOA1-----------------------March 27

NOA2-----------------------April 7

NVC letter------------------April 13

Arrival in Embassy--------April 20

Sent Back------------------June 2

Received by USCIS-------NOT YET (is the courier swimming it over?)

Sent AOS/EAD: March 30, 2007

Receipt Date: April 1st, 2007

NOA: April 6, 2007

Biometrics: April 30, 2007

Transferred to CSC: May 8, 2007

No news on any NOA2's at this point, although I'm optimistic that at least our petitions are already approved, hopefully that means something. The RFES will be rolling soon!!!!!!!!!!!!!!!!!

I don´t know. Something is telling me the situation looks worse for us.

Why none of us got touched yet?

People are getting RFEs with their receipt note from MAY!!!

People are getting touched 4 days in a row.

I think we all need to call USCIS on Monday and demand an explanation about the recalled cases.

People are getting RFEs with their receipt note from MAY!!!

People are getting touched 4 days in a row.

I think we all need to call USCIS on Monday and demand an explanation about the recalled cases.

I really don't see how it looks worse for us. All of the RFEs are probably going out at the same time. And our cases are already approved which means they most likely will be ahead of the game. The only ones that can probably light fires at this point are our representatives and senators who I will be contacting next week before my trip. So just continue calling USCIS and contact your representatives, that will definitely help.

It's the weekend, time to recharge, focus, and get prepared to contact our representatives next week.

Well... filing limitations apply regardless whether you've met through IMB or otherwise...

On the other hand, meeting through IMB does not affect the decision either IMO.

so, in short, forget about how you met. Pay attention to the new filing limitations which apply to everyone (which are btw written grossly wrong way in the current 129F petition IMO). So read the law, not the new I-129F instructions, for i beleive there are at least two mistakes in how they are spelled out in the petition form.

Maybe they will send it to the pending applications so once they get it back they can keep processing cases. Ours were already been approved, so they wouldn´t do much with it when they get it back..

Also, maybe they are still preparing the Consulates for IMBRA. We know they´ll need to show us a pamphlet or read something to the beneficiary at the interview.

That´s why i think we might wait to get our RFE.

It doesn´t make sense to me either, but I need to think of something since we have people with NOA1 from May (!!!) getting RFE.

Actually, they got an email saying they were getting an RFE, not the actual RFE itself. All communications with the USCIS seem to be saying RFEs will come in the next few weeks, most likely en masse. All people affected by IMBRA are in the same boat, we have to wait for our RFES to come in the mail. The online case status system email notification has been proven to be inefficient and unreliable because people get touched repetitively with no real information and people with NOA2s get no updates at all. Please chime in if I am incorrect.

In any case, just speculating is getting us all nowhere.

My main point is that the next best step for unsatisfied USCs is to contact our representatives.

Tinmaricel, I'm in the same boat as you. My dates are all 2 weeks earlier than yours (NOA1 on March 13, NVC on April 1, etc) but my petition was also sent back from Manila on June 2. I've received no update, and emailing NVC and CSC (even though it went through Vermont) both confirmed that it has not arrived in the US yet. I've been trying to call the Vermont Service Center since yesterday to see if their automated system has updated, but it keeps telling me that there's a problem accessing the info and to call back later. So yep, same boat as you. As soon as I hear an update, or can get through to Vermont, I'll post it. Please do the same for us Manila petitioners? :)

Packet 3 received: May 10th

Petition returned: May11th

No touches since the NOA2.

out of curiosity, who sent you the official letter of the recall - embassy, nvc, cis, dhs? we never received anything.

My finace got a letter from the Consulate three days after he got packet 3. Still no touches since May 1. I'm getting very pissed off.

Obviously this is fustrating to all of us. None of us in the recalled group no why we are not getting RFE emails. I think this is particularly hard to handle given how screwed we all feel. my fiance would be arriving in 2 weeks and with this delay and the current schedule in Moscow it looks like mid September at best.

However, there is power in mubers and having us share our information. I have yet to contact my representative but look to Lewis or others for advice on how to approach this. I suggest we all turn up the noise level as loud as possible if we don't hear something in the next few days. If the government were truly out to do the right thing (yea right) then we would get expidited interviews but I doubt that will happen. What will really piss me off is if the folks that have not yet been approved recieve RFEs and eventually interviews before those of us who had to cancel tickets/weddings/plans, etc.

The more things change, the more they stay the same...

When my wife and I went through the process in 2002, literally HUNDREDS of fiancees & wives were totally stranded in Moscow after congress mandated new background checks without giving DoS any resources or means to actually carry them out. These women had already had their visa interveiws, BEEN APPROVED for the K-1 & K-3 visas, and SURRENDERED their int'l passports to the embassy! It took some women more than 6 months before the matter was resolved, and they couldn't even travel anywhere else in the mean time.

It appears that Congress' grandstand stunt has left you guys in a similar but not quite as deplorable situation. The RFEs are obviously going to ask for the background checks on YOU mandated by the recently implemented IMBRA. Sad that Cantwell and company had to piggyback these new BS regulations onto a bill like VAWA because they knew it would never pass on its own merit, and a vote against VAWA would be political suicide.

Take heart that these things WILL work themselves out *eventually* but understand that nobody in our gov't gives a rats @ss about you or your fiancee - get used to it :( you'll have many more years of inane boolsheet to endure, and it doesn't really get any easier once she's (or he's) here.

I'm beginning to rethink the goverment corruption in Russia as possibly a good thing. At least their you can PAY (bribe) someone to not get screwed. Here you get screwed and there is nothing you can do about it. That our goverment works for the people is a happy childhood illusion. In truth they work for themselves almost always against us.
