Hi everyone!

I just got my NOA2 approval email this morning for the I-129F! Now I'm getting everything together for the interview, and I have one question:

Without a doubt I will need a co-sponsor for the I-134 Affidavit of Support, but I'm not sure if my mom would qualify as a co-sponsor. On her last tax return, she listed herself and my brother as a dependent (household of 2). For the poverty guidelines, she would need to consider my fiancee as well (household of 3), I'm assuming. But my fiancee and I have a baby together, so I'm not sure if that bumps it up to a household of 4. The baby is an American citizen.

If it's a household of 4, then she doesn't meet the 125% guideline. If it's a household of 3, she does.

Also, I was at one time married to a guy from the UK who has now been in the U.S. for quite some time, and now he's an American citizen. From everything I've read, once he's a citizen the sponsor no longer has an obligation to him. My mom and I did a joint sponsorship for him when we were doing his I-130 papers way back when. On the affidavit of support, it has a line about "previously submitted affidavits of support" and "previously submitted petitions". I know I'd have to list him because it's true that we filed these affidavits, but should I attach an addendum that says that he is now an American citizen? Would I somehow have to prove this? I'd rather know if I have to get some kind of document from him that says he's now a citizen.

US citizens are not sponsored so you count your children in your household but your mother doesn't count your children unless they are dependent on her. Mom's household would be three. You answer truthfully that somebody was previously sponsored but do not count them in the household if now US Citizens. You'll want to note in a cover letter that the person is now a US Citizen, as the Consular Officer may hot have access to that information.

Moving this to Consulate/Embassy forum. The I-134 is NOT requred at the time of I-129F filing, it is brought to the visa interview at teh consulate.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

No you said not to count the fiace because he isn't here yet. Notice that in both 3's above I've listed the intending immigrant in the household size. The fiance you said not to count is the intending immigrant.

Request denied.

this is confusing me too, im the USC and my mother is co-sponsoring, she puts me down as a dependent and im planning to bring my fiancee and child, my mother is currently married but my father is not part of the household as my mother files seperatley as HOH as well. how would it break down.

Co-sponsors only count the USC petitioner if they are actually a dependant.

You mother's household for immigration purposes consists of herself, any dependents, your fiance, the child and any previously sponsored immigrants. You father counts if he lives in the same house. For immigration, the filing status does not determine this, the reality does.

in this tax return she put me down as a dependent but when i filed mines i said no one could claim me as a dependent... so i dont know what to say but we live together.

The I-134 is different than the I-864, but if you will need the I-134 co-sponsor to be a co-sponsor when status is adjusted it is worth looking at the I-864 guidelines.

From the form I-864 Instructions:

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be asponsor, you may include additional relatives (adult children,parents, or siblings) as part of your household size as long as they have the same principle residence as you and promise touse their income and resources in support of the intending immigrant(s).
