removing conditions after divorce

hello everybody

i m in desperate need of help. i got married with us citizen and as a result of domestici voilence i got divorced. my divorced got finalized in august and i filed for removal of conditions in october 2008. i submitted the following documents:

-divorce decree

-marriage certificate

-lease agreement

-checking account details

-his emails and e cards

-photos

-statement from the school where we took classes jointly

-airline tickets showing travel abroad together

to show my good faith marriage. but still i got RFE and they are asking for more evidence of good faith marriage. what should i do. i m so depresed and need your help. especially if mamatom is reading this message i really need your help because my case is very much similar to yours. plsssssssss help me.

Well, I can say this: don't give up! I just got through and my card was ordered yesterday - just got the email today to say I was approved, so you can do it too!

I did have an action plan in place in case I got an RFE. I thought "I could submit affidavits from friends pertaining to the abuse" and I do know many people who would have helped me out with that. Also, more evidence of a valid marriage. More affidavits there - do you know anyone who would sign an affidavit stating the marriage was genuine? That's one idea I have.

Also, how about more photos - just send as many as you can. I think quality and quantity go hand in hand here. See if you can't submit as much stuff as possible - swamp them with photos and affidavits and more joint bills. That's what I would do.

Feb 2009 - Called USCIS to see what the heck was goin' on...

FEB 20th 2009 - Received email - GC on the way!

I am APPROVED for the 10 year PR Card!

you can file by yourself, file as MARRIED AND FILING SEPERATELY

Yes, but that's most probably the last year...what about your first year of marriage? Since you have to be at least two years married to apply the removal of conditions, and at least most of the time a year before get your green card approved...so in general at least one year you guys had to be filed jointly.

And in any case you cannot file as single, you two are married, so both can file as married even separately.

i don't have joint tax returns. coz he already made up his mind to forcefully deport me from here. so he did'nt file joint tax returns

i called his accountant he told me that he filed his tax returns as 'single'. i came here on K1 visa in Sep2006, got married in the same month, and got my conditional card in Dec2006. we separated in Apr2007, so their should be only one joint tax returnes. but i don't have any.

March 19, 2008. Conditional Permanent residence began!!

2009: Wake up and get on the uscis train again - lifting conditions

Dec 21, 2009. Eligible to apply to remove conditions

February 2010: 10-yr Green Card Received

FYI, If you were married and your ex filed taxes as single while you were married, as far as I'm aware, that's illegal... He should have filed Married Filing Joint, or Married Filing Seperately.

Actually he would be paying higher taxes if he did that. (Its not illegal - maybe just incorrect and probably incurs no penalties.)

Also, by the way, the poster is from Pakistan and in muslim marriages a divorce can take place on just saying that, "I divorce you". So, he can say that he had already divorced her under muslim law and was single at the end of the year!

I would hope the poster can produce proof of joint assets and affidavits from people attesting to their marriage. Good Luck
