London - Permission from Step chil's other parent

Hi

Just wondering about filing an I-130 for my step-daughter. She is 15.

Do we need to have a letter of permission from her mother (SD lives with us not her mother) to go with the I-130, or will it be okay to wait until interview?

You will need a letter from the biological mother IF you do not have full custody of your daughter.

If the father has joint custody, then you will need the letter.

The letter is needed at the interview stage.

Apr. 6/05... DS-230, Part I faxed to Vancouver Consulate

May 26/05... K-2 Interview - APPROVED!!!!

Sept. 5/05... Entered U.S.

Sept. 7/05... I-485 & I-131 sent to CLB

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

My SD has been living with us for almost four years now. Getting a letter from her mother might be difficult as she "doesn't want her to go". SD is 15 (will be 16 in July) and she has chosen to go with us. We intend to have a letter from the mother of course, I just wondered if it needed to accompany the I-130 when filed. (and obviously my question was very muddled!)
