When can I file GC petition for my mom?

Hi everyone,

I am the citizen to-be, and am planing to file GC petition for my mom. She came to the States as a visitor, and is currently in U.S.

My question is, I can file the petition for her right after I get my naturalization certificate in oath ceremony, correct? (we will file I-130, I-485, I-864, G-325a, I-693 all together).

Another question is, after we filed her petition and get the NOA (not sure how the process is, assuming there will be a NOA), can she wait for her GC here in U.S. even after her current visitor visa expires?

This is the same as any other person adjusting status from (Work/Visitors/Student) visa they will be AOS pending.

:no: This has come up before. A parent can adjust status from a visitors visa based on an immediate visa number being available for them. An I-130 and I-485 are filed together, again this can only be filed AFTER the son/daughter first becomes a US Citizen.

form I 485 directions:

1. Based on an immigrant petition.

You may apply to adjust your status if:

A. An immigrant visa number is immediately available to you based on an approved immigrant petition; or

B. You are filing this application with a completed relative petition, special immigrant juvenile petition, or special immigrant military petition which, if approved, would make an immigrant visa number immediately available to you.

You need to double check the information you are giving because as a immediate relative of a USC she can file to adjust her status to LPR as long as she was inspected on entry and did not enter with the intent to circumnavigate the immigration laws.

She can remain in the US while her AOS is being processed and she should not attempt to leave until she has her greencard in hand.

my husband filled petition for me when he was LPR that time of OCT 2005. we only received receipt Notice.

then after 6 years staying in US he apply for N400 and God Grace this coming March 19 he will attend his oath taking.

please help me...im asking u question and hoping you will help me. How do my husband upgrade his petition for

me. Do we need some form or he just write a letter asking for upgrading the petition.?

I'm not positive but this looks like when we filed for my green card through marriage to a USC. At that time, we had to submit two G-325a's, my US citizen wife's and mine.

Double check though since I'm not sure
