I married my foreign born spouse while she was legally in the US with a valid J-1 Visa/I-94.

We have submitted all of the required documents for her adjustment of status (AOS) and received the NOA-1's as receipt (I-130, I-765 and I-485). I realize that the NOA-1 probably has no legal power, however, her J-1 and I-94 will expire in about 30 days and I was wondering if at that point she will be considered "illegal" and pending deportation? Has anyone else been in this situation before????

Also, our receipts numbers are not recognized on the USCIS website and I HAVE entered them correctly. I've read that this can take up to 4 weeks to "enter" the system - when should we start to worry (if at all)?

just about every K-1....

I wouldn't consider most K1 visa holders in the position of coming on a J1 visa

but I do see that you are likely referring to the expired I-94

02-27-08 NVC processed petition

02-28-08 Received NOA2 in mail

03-03-08 Consulate in Rio de Janeiro received petition

03-21-08 Received packet for interview

04-22-08 Visa Interview and Visa APPROVED!

05-06-08 Visa received in mail

07-28-08 Wedding Date (Reception was 26th, but forgot to reigster for MC...oops)

10-04-08 Applied for AOS (EAD and AP also)

10-09-08 NOA1 for I-485

10-27-08 I-485 transferred to CSC

11-04-08 I-485 Biometrics appointment

11-13-08 NOA1 for EAD

12-09-08 EAD Biometrics appointment

01-08-09 AP Approved

01-13-09 AP Received

Cost of 3 roundtrip tickets to Brazil in last 3 years...... $2,900+

Cost of filing petitions for K-1 visa & AOS.................... $1,465+

Cost of monthly calling cards to Brazil........................$20

If you applied for Adjustment of Status, I think she is OK.

She's ok AND in exactly the same status as a K1 filing AOS....PROVIDED....there's no home stay requirement noted on her J1 visa.

If you applied for Adjustment of Status, I think she is OK.

She's ok AND in exactly the same status as a K1 filing AOS....PROVIDED....there's no home stay requirement noted on her J1 visa.

Nope, there is a section on her original J-1 which is checked off as "no 2-year requirement" so I am pretty sure it does not apply to her.

She is not illegal. Her status - AOS pending.

I also had J1 visa, but I was out of status when I got married. So I have the same status.

Removing of Conditions

May 9, 2011 - October 4, 2011 (approval on September 28th)

Naturalization

July 19, 2014 - N400 packet sent out

July 21, 2014 - N400 packet delivered

July 23, 2014 - received email/text that I-797 is issued

July 26, 2014 - received I-797 in mail

August 11, 2014 - received the Biometrics notification

August 14, 2014 - biometrics walk-in (original date August 20)

August 18, 2014 - in line for interview scheduling

September 9, 2014 - yellow letter is received (letter is issued September 3)

November 3, 2014 - interview notice is issued (email/text alert)

November 10, 2014 - interview notice received with the interview date of December 11, 2014.

November 10, 2014 - request to reschedule mailed out

December 5, 2014 - interview notice is sent out (email/text alert)

December 11, 2014 - received an interview letter in mail

January 10, 2015 - interview on Saturday at 7am

January 26, 2015 - sent the requested documentation

February 26, 2015 - oath letter is issued (email/text alert)

March 2, 2015 - oath letter is received

March 18, 2015 - oath at 8am
