Hi all

My mother in law was in USA for like 2 years and then went to India.She was issued the green card in 1980's which means that her green card doesnt have an expiration date.

She has been in india for more than 20 years and has never come back to US.

Will her green card be still valid coz it did not have an expiration date?What shd we do

please let me know

i doubt it. whether it has an expiration date or not, once u have the green card, you have to be in the US or US territory within a 365 day period. So even if she lived in India, she would have had to travel to the US each year after she had gotten the GC to keep it valid. If she has been out of the US for more than 20 years, i am pretty sure her card is no longer valid.

She can go to the US embassy in India and ask. Also, she can call USCIS and give them her A and see what happens.

She has left the US 20 years ago and that means she is not eligible to return on the same Green card, US is not her country of permanent residency anymore and also she has not filed US taxes as US resident, which by itself makes her green card revoked.

She wound have needed a re-entry permit and to get that she would have had to prove that she was still resident in the USA. Her LPR status would have been lost when she had been outside the US for more than 12 months.

She would have to start over with a new visa application to be able to return after such a long time.
