Hey everyone.

I been married for about 4 years now and last year I was legally separated from my wife (we had a separation agreement, however nothing was filed with a court). We got separated due to affair on her par t. She moved out and moved to another side of the country. She does not blame me at all, she is willing to testify in front of INS if its needed, come to all interview etc. Before we got separated we filed for I752, it got approved without interview. If I would file n400 under conditions of being a resident for 3 years and married I heard since we were separated I might get in trouble with INS and green card could be revoked. Here is a real question – we are truly thinking about getting back together – so separation agreement will not be a problem. However we leaved completely separate lifes. How will it look in the eyes of INS? what should I do, should I apply, will I get in trouble? Should we just get back together and apply later, if we will not work out – should I file after 5 years ?

Please help!

Probably best to wait for the 5Y mark. Better safe than sorry. Think about it, 2 years extra is really not THAT long.
