Re-entering on B1 with a K3 in AP

Brief overview---

Met in 2008 while he was here on a B1. We married, he went back to work in his country and I filed Cr1/K3. He was approved on Dec 1, pending AP.

He emailed the embassy to ask if he can travel on his B1. They sent it to DOS and they emailed him back that he can indeed travel on it. AOS has to take place here anyway.

Is this ok to do? (he could have come back anytime, I was under the impression the marriage canceled out the b1) Is there a risk to the CR1 if he comes and we file the AOS?

Thanks in advance for any opinions.
