I am really upset at people marrying on VWP!!!!!!

And, of course it's your privilege to feel that way and your right to express those feelings. However, since this is an immigration forum people come to for assitance with their visa journeys, it's important we remain clear on what is and isn't allowed. We must not confuse what IS with how somebody thinks things SHOULD BE.

Here come the europeans lol. Yeah, I would. What's the point? The loophole is there, people exploit it. That's fact. I only feel personally that the loophole shouldnt be there, that the same process should be followed by everyone no matter what country they are from. That means that a B visa, either by waiver or issued at a consulate abroad, should be used for just that - a visit, a return home, and re-entry after background checks are done, medical checks are done, and the correct visa type has been issued. Nothing personal, it's an equal protection / equal treatment thing. I have no sympathy for someone who takes advantage of the VWP and uses it to immigrate just because they are "scared of the immigration process" and an immigration officer told them "you have to have a visa next time you enter". Especially in light of the fact that by the way and as it turns out, that immigration officer was dead-on right about you after all. Last comment on this, don't bother to reply.

I would give this up. This is an old war on VJ lol...... All you are going to do is get the mods with spouses from Canada, Europe, and Australia mad at you and they will eventually cancel your account just from spite. I know this from personal experience. Is it wrong? yes. It pisses me off every time I see the thinly worded suggestion 'be sure you can show you didn't "intend" to get married'.....The long and short of it, the way things are now, it is easier to prove "non-intent to marry at entry" than it is to prove "proof of valid relationship" and legally follow the immigration process in the first place. Anyone who came in as a visitor and just "decided to get married" and stayed here didn't have enough ties to their home country to qualify for a visitor's visa in the first place. Its still the good ole USA. "White" countries enjoy a higher level of immigration benefits than "brown" countries. Until that changes and everyone is "equal under the law" (that's another laugh) then this loophole will continue to be exploited. Me? It isn't personal, but I'm all about sending VWP applicants' a$$ right back home to wait through the legal process (since they have "ties to their home countries" haha like jobs, etc) just like the rest of us had to wait. No ties, then they entered illegally to begin with, and they should be banned from entry or have to file waivers pay fines just like people from "brown" countries have to do.

You would give this up? Obviously not... :blink:

We have to drive to Charleston, West Virginia today for my husband to have his biometrics taken - again. So I cannot stay on here to watch this nonsense.

But I've got two things to say about this.

Number One - if you are so bored that all you have to do is whine about the VWP, you really need to get a life. This whole process sucks, all right? If you are married to an immigrant, you better stop worrying about how they got here and worry about how they are going to feel living in a country where they are treated like second-class human beings and have to prove themselves over and over again to the US government for the privilege of staying here.

Secondly - Talking about brown, yellow, red, etc - just wrong on an international community. Just wrong.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Everyone has the right to their own opinions. You have the right to feel mad at people who you feel are abusing the system.. What you don't have the right to do is judge everyone doing AOS from a VWP/Tourist visa as if they all planned to commit visa fraud.

They are using a legal route afforded to them under immigration law. they do not deserve to be tarred with your Visa fraud brush, by all means be angry but don't make public statements unless you know the law and know all the facts of the people involved.

I adjusted status from VWP and it was not as easy as she is painting it. Each to their own, she doesn't know everybody's circumstances but still she is lashing out.

As someone has already mentioned, there are risk, it is not all a rosy road and she has to take into consideration that some of us had a lot of unfinished business in our countries. Being months and months in limbo without being able to work or do anything is not fun.

Anyways I stop in here. Everybody has the right to have their own opinions but making such statements on a public forum without knowing the full facts is uncalled for.

12-16-07 Arrival in the US from Good Ol' Blighty

02-13-08 Got married in Los Angeles

02-22-08 Civil Surgeon Appointment

Adjustment of Status

02-29-08 Sent I-130, AOS, EAD, AP (Via FedEx) to Chicago

03-03-08 Package arrived in Chicago

03-07-08 All Cheques cashed!!

03-10-08 NOAs for I-130, I-485, I-765 and I-131 received

03-16-08 NOAs for I-130, I-485, I-765 and I-131 touched

03-27-08 Biometrics Appointment at 2pm (Notice date: 03.11.08)

04-30-08 Received EAD "card production ordered" & AP Approval notices from CRIS (YESSSS!!!!!)

05-06-08 I-765 touched and AP received in the mail!

05-08-08 Received I-765 "approval notice sent" e-mail from CRIS

05-09-08 EAD received in the mail (YIIPPEEYY!!!)

OoooooooOOOOOooo... I AM REPLYING!

He didn't abuse the VWP - the times he came and visited, he always left on time and never overstayed. The people at the border gave him grief cause he's from a country that is allowed to come and go without a visa. Have you ever been detained at the customs and being laughed at, left in a cell for 2 1/2 hours, no wallet, questionned short of a strip search and being scared?! Go through your cell phone numbers, your text messages - then the officer misrepresented himself and called me trying to "book" a gig to see if he was coming to work here illegally? That is all non-sense to me. It scared the ####### out of us, it ruined out time together and shook the idea of our future together. We didn't have the intent on getting married when he came, but that "Dead-on right" treatment as you call it, changed our mind.

Its ok if you call me VWP-TO-AOS abuser. I know my intent. I am sure I am not the only one who decided to get married after their love have been given so much grief when they entered the USA.

i LOVE how the OP thinks she is the ONLY one who is doing the immigration process legally. Get over yourself, your not the only one who is and has done it legally. deal with it, and move on. Maybe you should focus more on your own case, and less worrying over everyone else.

Excellent point, especially as I have posted more than once about how much delays/frustration I faced going from single TN-1 holder to married USC.

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

Most people here are doing it legally. You (OP) aren't the only one. Some have shorter timelines some don't. Some get to visit the US on various visas or VWP and get married and adjust status, some don't. What are you going to do about it? Get upset and make it even harder for yourself? You decided to take the K1 route. Nobody else decided for you, so why get angry with others? sheesh!! immigration process is not easy for anybody. If you can find 100s with better timelines, why not look at the 1000s with worse ones too? Get over it!

Maybe I should be angry with every couple who got to be together after coming to the US and the husband did not get deployed!! :lol:

yeah, I guess the world doesn't work that way huh? it's the opposite, be happy for other people's unhappiness and be unhappy for other people's happiness.
