I am really upset at people marrying on VWP!!!!!!

Am I the only person honest who tries not to jump the system?

I was reading the forum about adjustment of status and I found out that many people take advange of the VWP!

I have been several times in the US to visit my boyfriend with the Visa Waiver Program but it never came in my mind to cheat the system getting married and adjusting my status there.

I am suffering now being away from my love but I know this is the right way to do things. I just started my journey and the day I will be again with my love is very far!

As a citizen of a country partecipating at the VWP I am upset for all the people who need a visa to go to the State and us....lucky people...we jump the system. Maybe I should say that I am stupid because I had the opportunity to stay in the US with my love and instead I chose the honest way....

... i married my husband on the visa Waiver program. After they gave him SO MUCH GRIEF at the customs for coming to see me many times, we got scared and got married ( after they told him he would require a visitors visa next time ). Maybe you should get mad at the people that harrassed my husband at custom. Many people have had things happened to them while here on a vist like parents got sick, they got sick that changed their normal course of action to do it that way. you cannot judge them or be mad at them for doing such thing...

... Are you the only one that is honest?! come on, i AM honest, we didn't plan on getting married, we just did. It's not fair to imply that people that marry on the VWP and do the AOS within the USA are dishonest. Different strokes for different folks. There are risks adjusting on the WVP.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

If you do not know all the circumstances as of why people did it that way, its quite unfair to press judgement in my opinion.

Anais, you already know I did things the honest way. It would have been impossible for me to abuse the VWP anyway, since I have way too many loose ends to tie in Italy, and in my case it would have really been fraud of the first order. However, many people who do get married on the VWP don't do it to abuse the system, but because in that particular moment it may really be the best solution for them. That said, I'd rather not say anything about what I think of the whole immigration system, since I have already got into scraps with other members in the past, and I'd rather avoid it.

Marrying on the VWP is perfectly legal. Entering on the VWP with the intention to BOTH marry and immigrate is where you break the rules. Marry and go home, no problem. Already here when you decide to marry and stay, no problem. Already married and come to visit then plans and circumstances change and you stay, often OK.

Planning in advance of entry to circumvent immigration law is where people go astray. There are plenty of legitmate uses of the VWP or visitor visas that result in equally legitimate adjustments to LPR status. Before you get angry about others breaking the rules, make sure you KNOW the rules.

Let's face it. Everyone knows its splitting hairs...intent, not intent.

If you come, bags packed...everything "tied up" at home and then try to say you "had no intentions" youre full of it.

I dont think any logical person can disagree there.

Then its the person's ( couple ) risk to play with fire when it comes to interview time. There are risks and its up to people to weight the probability of being faced with visa fraud. If you know you did it the right way, then you should be satisfied with your own course of action - why caring about how the others do it and waste time on that? so I guess you think I am a dishonest and bad person for getting married to my husband on the VWP? It's obvious how you have your mind made up on that matter

You know, I kinda feel like "who cares?"

There are people who abuse the system by PLANNING to get married when they come on VWP and there are people who abuse the system by marrying an American for the greencard and then leaving them.

I would like to give the benefit of the doubt to some of the people I know who came here on the VWP and decided to get married while they were here. There are people who do that with absolutely NO INTENT to defraud the immigration system.

It sucks to have to wait, but it doesn't serve any purpose to complain about people who file AOS from the VWP. It really doesn't. What about the people who got their K1 Visa in less than 3 months? Should we complain about them too?

I mean, sheesh VJ, enough with the whining.

I am talking about my own experience.

I personally know people married on VWP and I think it's not fair what they did (they came with the intention of getting married and jumped the system in purpose). :angry:

I don't want to judge all the people doing this, I judge from what I saw with my own eyes.

Please leave me the right to be upset since I am not able to see my love because of our decision of doing things the "right" way or maybe I should say doing things in one of the possible ways...maybe the worst one...

I am not here to judge anybody and I don't want to hurt the feelings of anybody, I only want to say loud how I feel! :crying:

I don't make any judgements about this. You are doing it by the book. It is very easy to do it NOT by the book if you are from a VWP country. Should I be angry at YOU because MY fiancee was treated like some sort of animal when she tried to get B-1 visa a couple years ago to attend a business function in NYC? Should I be mad at YOU that you can visit the USA and she could not? Oddly enough one of the countries my (now) wife wants to visit is Italy and NOW she will be able to, but before was turned down flat by the Italian government because she was from Ukraine! So there are all sorts of injustices all over the place. You could, legally and above board, come to the USA, LIVE here on the VWP with your fiancee and return to Italy only for the interview, if you want. You could get married, live here as a visitor under the visa waiver program and apply for a K-3 visa, again only returning for the interview. You have tons of options my wife never did, and I do not get angry with YOU. And there is no need for you to be mad "for" my wife.

You have the great advantage to make these choices. The only thing I would object to is someone not following the law at all, not filing for AOS, not submitting themselves for backgraound checks, etc. Where, when and how they do it really doesn't concern me. I COULD have chosen to live in Ukraine under the one-way VWP we have with that country, but did not for our own reasons.
