No you do not have to give up your Canadian citizenship :)

K1 is just a visa (has no effect on citizenship) - neither does obtaining a PR/Green Card. Further down the road - you can become a naturalized (US) citizen, and even that does not require renouncing your Canadian citizenship. :thumbs:

Lets make it a "yes u can visit the USA while the visa is ongoing " thread then,lol I gave up my Cdn citizenship, BUT kept my Saskatchewan citizenship instead,lol just kidding!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Hi Im wondering with this K-1 Visa what does that do for my Canadian citizenship? SOme people say I HAVE to give it up to be American and others say no....I don't really want to give up my citizenship if I don't have to.

It has nothing to do with your citizenship in Canada. You will be a US permanent resident and citizen of Canada. In the future you can apply to become a US citizen IF YOU WANT, you do not have to and with Canada we have a dual citizenship agreement and you can be a citizen of both countries, IF YOU WANT. Citizenship is completely separate from K-1, marriage, AOS, etc.

Minor correction: we don't have a dual citizenship agreement with Canada, nor with any other country for that matter. Each country gets to decide who is or isn't a citizen of that country. The US decides who is a citizen of the US. Canada decides who is a citizen of Canada. The US doesn't get to decide who will be a citizen of Canada, nor does Canada decide who is a citizen of the US.

Dual citizenship happens, not because of some grand agreement, planning, or signed treaty, but simply because each country writes its own citizenship laws in its own way, without much regard for the laws of other countries. Sometimes the laws of two (or more) countries will each claim that an individual is their citizen simultaneously.

In the OP's case, when you get a K visa or green card, Canadian law doesn't say that causes your Canadian citizenship to end. And in fact, if you choose to continue and get US Citizenship, Canadian law still says that doesn't cause your Canadian citizenship to end.

soo glad I kept my Sask citizenship!! far less complicated!! lol In Sask if one were to ask this question we would just say: NO, then go for a beer!! lol

In fact, to lose your Canadian citizenship you would have to fill out and submit a specific renunciation application form in writing to Canada's Department of Citizenship and Immigration. Canada officially recognizes dual citizenship for its citizens with other countries. The US doesn't - it just pretends the issue doesn't exist and ignores it.

So......... you're actually telling a "little white lie" when you say that you will renounce all other citizenships (or however they word it) at the Naturalization oath ceremony.
