A few questions i hope someone can answer for me

Here is the deal, i flew to the philippines and got married, i also extended my visa while i am here (currently here).

When i get back to the usa, the plan was to pay an immigration lawyer for k3 processing, sadly, as a teen i got convicted of having consensual sex with my girlfriend who was 15. The Adam walsh act is going to #### up my life

So i was thinking, since we just married, can my wife here just apply for a tourist visa, (which im sure she would get, she has a good job here) and come to the usa, and just not leave, since we are in fact legally married and i am a usa citizen?

So we can bypass all the bullshit? thanks to anyone that knows , she hasnt changed her passport or id to my last name as of yet

and before the negative comments, yes she knows, and yes we are both adults thanks

I would be pretty sure she would not get a Visitor Visa, not impossible but close to it.

If you were convicted of having sex with a girlfriend who was 15, you didn't have consent. Period. Hence the conviction. Did you look in the IMBRA section of VJ and view the threads on the Adam Walsh Act? That might help you insofar as information for others that have or are going through this right now to read their stories. I don't know that anyone that WE know of here on VJ has been successful at this point in petitioning their fiance or spouse with a prior conviction of a sexual offence at this time.

I highly doubt your wife, even with a job would get a tourist visa to come visit the US. Her country of birth/origin is very vigilant in not giving out tourist visas.

No, you cannot "bypass all the bullsh*t" and bypass the LEGAL process to get your wife here. We would never advocate that anyway!

You might try looking at avenues to work and live now in the Philippines. There are many Philippine/American couples that are living there, or are looking at one day retiring there, so that might be your best bet at this time.

Laws, rules, and regulations might change over time, then enabling you both to immigrate at some later time.

No. Marrying a USC does not entitle you to anything. You MUST follow immigration laws. If you chose to attempt to bypass the immigration BS, your wife faces deportation.

PS I agree with Carla, you did NOT have consent when you had sex with a 15 year old.

I dont have any negative comments about your past. But you wont receive any advise on how to commit visa fraud on this board. That is what you are impying and it's illegal. A tourist visa is for tourism, not "just staying"

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

So, you say my choice is to stay here, which, would be fine, but then, if i dont register as a sex offender in the usa, they will say failure to register and try to charge me if i ever return. Im not sure how i can provide for her here , or how i can stay here legally , any ideas?

Perhaps there is a forum out there that is for people wanting to immigrate to the PI. I think there is potential for eventually getting a waiver but it's a new law. I haven't seen any success yet. US courts do tend to make certain distinctions for non-forcible sex with a minor when both parties are teenagers, even if "consent" in a legal sense is not possible. "Consent" has a legal connotation in this context so you're always going to get an argument using that term to describe your actions. "Statutory rape when both teenagers" is probably an accurate and more descriptive term that will avoid arguments and indicate you take responsibility for your illegal actions.

The wife of a US Citizen is not going to get a visitor visa to the USA under most circumstances because her immigrant intent will make her ineligible. Maybe after the two of you build a life and assets in the PI, she could get a visa to accompany you on a visit but there would need to be significant evidence of ties, enough to convince a Consular officer she would be returning to the PI after the allowed visit.

Your choices have limited your choices. I'd say you can choose a very long separation or to be together in the PI.

You should try in the IMBRA forum. If you arent as obvious in asking for advise on how to commit fraud, you may find some helpful advise.
