which form should be used I-864 or I864EZ?

hi,

i applied for my parents to come to america and their I-130 forms were approved. now i have to send the affidavit of support but i don't know which one to use "I-864 or I-864EZ form? they are very similar and i already called immigration services and NVC but they said they couldn't help me because i have to decide it by myself. so please, somebody help me, thanks.

i used the I-864 but i dont know which one you need to use maybe it works different for each country. call the NVC and they will tell you which one to use for sure.

This is the instructions taken from I-864EZ

Who May Use Form I-864EZ?

You may use Form I-864EZ IF ALL the following conditions

apply:

1. You are the person who filed or is filing the Form I-130,

Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on

the Form I-130 petition;

3. The income you are using to qualify is based entirely on

your salary or pension and is shown on one or more Forms

W-2 provided by your employer(s) or former employer(s).

So use I-864EZ if YOU ONLY is the sponsor of the ONLY ONE beneficiary. If you have a joint sponsor use I-864. I hope it helps.

01-20-2009 DS3032 and AOS Fee Bill generated

01-24-2009 AOS Fee Bill received, paid, DS3032 sent by email

01-28-2009 AOS Bill shown paid

01-30-2009 Choice of Agent accepted by email confirmation, paid IV bill

02-02-2009 IV Bill shown paid

02-05-2009 Send AOS Package

02-09-2009 IV Bill received

02-10-2009 Send DS230 Package

02-11-2009 NVC received both packages

02-19-2009 Case completed

02-25-2009 Case forwarded to JAK consulate

04-20-2009 Fingerprint appointment

04-23-2009 Interview date - Success!

06-04-2009 No news from USCIS so we go to SS office to apply for SS

when you sudmitted the I-864. were you the only sponsor and did you apply for both of your parents?.if you can help me with this , i will really appreciate it, thanks.

You can file either one. The I-864EZ is "easier" to fill out than the I-864 but they both serve the same purpose. I filled out form I-864 for my husband for his CR1 visa even though I was the only petitioner, he was the only beneficiary and the info was based on my tax return and salary info. The reason I used I-864 was because I was not aware that the I-864EZ existed.

So it's no big deal.

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
