Questions on I-485 and I-864

Hi everyone,

I am the citizen to-be, and am going to file GC application for my mom. She came to U.S. on visitor's visa, and is currently in the U.S. Can any one possibly help with my questions below:

1. on I-485, Part 2, Application Type, shall we check (a). petition based on immediately available immigrant visa number (I'm planing to file I-485,I-130,I-864,G-325a, &I-693 all together), or (h) other basis of eligibility?

2. For I-864, item 24, My current annual household income, I only put my annual income here bcoz my income > 125% of Federal Poverty Guidance. But in item 25, Federal income tax return information, I have to put combined AGI including my husband's and my income, bcoz I am married and filed joint tax return. So the income numbers in item 24 & 25 looks a little bit inconsistent, IS IT OK to file this way? (I will include IRS transcript of 2007 and my w-2 in last 3 yr as supports).

3. If the answer to my question #2 is OK, my husband would NOT need to file I-864A, is that correct?

06/09/08: received biometric notice (notice date 06/05/08, priority date 05/28/08)

06/19/08: biometrics

12/08/08: interview - approved!

02/26/09: oath ceremony

1) "A" this is based on the attached I-130.

2) You can have your spouse attach an I-864A to add his income to that of yours to use the combined income number on the joint tax return. OR you can simply provide the transcript, along with a copy of your W2, 1099 etc..

3) See #2

Note: you need to file this AFTER becoming a US citizen.

Thanks YuAndDan. I still remember that you helped me with some of my questions back to the days when I filed for remove of conditions. Thanks a lot.

I know I am getting pretty redundant here. But just want to make sure, for I-864, if I only use my income, and provide IRS transcript and my W2, we should be fine, correct?

Correct, a copy of W2 will show your part of the income listed on your return.

Correct, a copy of W2 will show your part of the income listed on your return.
