O Gosh I just read the new I 129F form.......

OK here's the story,

my boyfriend has been accused of raping some girl years ago,from what I know she pressed charges against him but she never showed up in court and the case was dismissed.He was not convicted or anything.The woman was nothing but a liar and did this to him oput of God knows what reasons.

Now my question is what would he have to put in? Does all this effect him since there has never been a conviction?????????

If there is no conviction and there is nothing on his police check i have the feeling all will be fine.

YOu could send off for his police check now (valid for 12 months) just to put your mind at rest.

Sorry, but just because she did not show up in court does not mean she was not raped. I know you have a desire in your heart to believe everything your boyfriend tells you that does not necessarily mean he's telling the truth. There are always two sides to a story and you have only heard one side. Jeeeesh

The new 129 form is available. If you read it you will see a question about past criminal history. It says if he was ever "convicted" of a crime it must be reported....... You should not have to worry about it from an application standpoint.

I have to agree with this statement, you wish with all your heart that your boyfriend/fiance is telling you the truth and it could be that he is, just because the other party does not turned up at court does not mean he did not do the act it just means there was no case to answer as the other party did not give evidence in court. I hope you know what it is that you are getting yourself into, I personally would find it a very hard decision to make on weather you SO is worth marrying or not. Try to find out as much as possible about this case and decide from there, your future is at risk if this turns out to be true. Know the facts yourself, do not take what your SO tells you as the gods honest truth.

phew I'm glad someone said that. I have been thinking about this all day. I think it's kind of weird that you said she is just a liar and you don't know why... well why would she lie about it? What would she gain from pretending to be raped? Women are raped and it's not always violent... in most cases women say no but the man goes ahead anyways... maybe they were drunk who knows. I know you want to believe your fiance but don't say she is just lying because you do not even know this woman or the circumstances or do you? I doubt she lied about being raped which is something serious for no reason. I was really disturbed that you said she is a crazy liar etc. I know you want to believe your boyfriend it's normal but maybe he did rape her... sorry...maybe it wasn't violent but maybe she didn't say yes.

I am told by someone in the police force that they can indeed see these charges whether or not a conviction took place.

you're not even together yet but you've had so many problems with jim ... and now THIS!?!??! what else do you need to be hit with before you step back and evaluate this relationship!?!?

he thought he was divorced for the past year & a half, bought cable & DSL when it wasn't in the budget, he continued to chat with other women online, he recently lost his job, and NOW a past rape charge against him??

this is coming from someone who can look at your situation without interjecting emotions into it ... again, please make sure this is the right move for you and your 5 yr old son.

With all due respect, the accusation is a very serious issue.

Despite the lack of a conviction, I would be be a bit concerned at this point. Statistics prove that this type of accusation generally has merit.

You may want to consider an NCIC check. With that said, That is one of the primary purposes of the IMBRA deal.

This surmises that the person is the petitioner.Suggest you run this issue to ground. Just my opinion. Best of luck.

I KNOW he NEVER raped anyone.And he told me about this story right after we met so I knew it all the time.

I HAVE BEEN raped twice and by God I know Jim is NOT the type of guy who would ever rape someone.

He is the most gentle and loving man I know.He takes my son who's got ADHD and is really difficult to deal with the way he is and doesn't treat anyone badly.

This "woman" was simply pissed off at Jim for NOT doing anything anymore after he told her he didn't want to see her anymore.And then she turned around claiming he raped her and on top of that that she was pregnant.

Now how come there's no child????? How come she never sued for child support?????? How come she never showed up in court???? How come there was no medical evidence that she WAS raped???

Sorry people but I KNOW my man and I kow for reason that I surley wont discuss here that he would never rape anyone and never did.

I know exactly what I'm getting myself into with that man and I know he's the best thing that ever happened to me and my son!!!!!!

I love him with all my heart and so does my 5 year old.

As for losing his job,

his BOSS told me it had nothing to do with his work performance,they simply didn't have enough work anymore and since he was the last one hired he was the first one to go.

Cable and DSL,oh well....he's a man and after all it's HIS money.

And as for him chatting with other women,hey as long as he's just TALKING who cares????

It's MY life and I love him and I know he loves me so why is it that people think they have the right to judge someone they don't even know???????????

All I asked is that you not judge HER. Unless you were in the room you have no idea what happened. You know one half of the story and I doubt very seriously whether he would confess to you if indeed he had raped her. You are living in a fantasy world and if you don't want others to judge you or your SO then you certainly do not need to pass judgement on the girl who claimed she was raped. You not only asked advice but made statements against the other party. It sounds like this guy is Mr. Perfect and you might just be a bit desperate. Yeah, right.

I'm sorry for the negative responses you received. I was looking to ask a similar question.

My fiance has a domestic violence conviction which was an accusation his kid's mother made when she wanted my fiance and couldn't have him. My guy had their toddler in his arms and the mother was grabbing at the boy's legs - she frequently threatened to stop visitation if she couldn't have her own way. During this struggle - on a main street - my guy gave her a slap on her forearm with an open palm to get her to stop pulling on the kid's legs. He then said he would take the kid for a walk and an icecream and bring him home to her shortly. When he got back to his place 20 mins later the cops were waiting for him as she had called 911 crying kidnapping and battery.

I supported him through his trial and lead up to it, I saw the photos of her so called "injuries" - there were none. I talked to him all through his community service hours and he talked to me every week about his weekly anger management classes.

I find it bizarre that he was ever convicted for this incident. Considering 'justice' is meant to be paramount to the American belief - it was crazy to see this happen.

So although I already know the intimate details of this situation, I'm concerned that some USCIS officer may be able to decide on my behalf whether our relationship should be allowed.

Is anyone aware of what delays above and beyound what the innocent are experiencing??
