Hey all,

My fiance's older daughter is 22, married, and deaf. The marriage is falling apart, and I'm wondering if there is an exception to the 21 and married rule that we can take advantage of because she is deaf. Work options in Russia will be very limited for her. It is possible that she will arrive on her mother's door step the day before Mom moves to America.

I'm looking for advice on my options from you experienced folk.

Unfortunately no.

Your fiancee will need to enter the USA Marry, apply for green-card, get green-card, at this point your spouse can file an I-130 for daughter IF daughter is no longer married, the visa class will be Family-Second (F-2B) which at this moment is taking close to 9 years to get a visa number.

Lots of LPR want to bring their children to the US. The US limits the number of immigration visas because if every LPR can bring over family to be LPRs then they can bring additional family over, etc. You get the idea. Eventually, you have a bunch of LPRs who are new to the US who have no idea how our society operates. Since there are more people wanting visas then there are available visas in any year, certain class of people have to wait in line until a visa becomes available.

You need to look at the immigration categories. USC petitioning for spouses, parents and minor children have visas immediately available to them. LPRs who are new to the country need time to establish their financial stability so they generally have to wait longer to bring their adult children to the US.

P.S. If your fiance obtains her green card, she can not petition for her married daughter as there is no immigration category allowing an LPR to petition for a married child.

Would not work options in the US be very limited as well?
