Hi all VJers,

needed your assistance for filling out the aos forms . I am the nonusc filing out based on marriage to my wife who is the usc...adjusting from B1/B2 visa.

i) I-765 line 15 & I-485-CURRENT USCIS STATUS.... WHAT TO WRITE ? I am on 8 months overstay from the time of the POE stamped departure date.

ii) I-765 line 1 : Which USCIS Office?

iii) In G-325a line "This form is submitted in connection with....." does USC and non -USC both check in "status as Permanent Resident" ?

iv) I am attaching a check of $1010 with form I-485 and $355 with I-130 , both addressed to US DEPARTMENT OF HOMELAND SECURITY. Is this right ?

v) I am not filing I-131 (AP) as i guess people who have overstayed may not be allowed to re-enter even if they have an AP. Thus its best for them to leave with GC. Right ?

vi) Regarding sending the forms :

If the Form I-130 petition is being filed concurrently with Form I-485, Application to Register Permanent Residence or Adjust Status, submit both forms concurrently to:

U.S. Citizenship and Immigration Services P.O. Box 805887 Chicago, IL 60680-4120

For private couriers (non USPS) deliveries:

U.S. Citizenship and Immigration Services Attn: FBASI 427 S. LaSalle - 3rd Floor Chicago, IL 60605-1098

which service is cheap & best ?

Thanks for all your help !

1) What-ever Visa Holder.

2) Has to do with if you filed for EAD BEFORE.

3) Status as permanent resident for the one attached to I-485, and "Other" I-130 Petition for the petitioner and beneficiary ones attached to the I-130.

4) Correct

5) You are correct, it is NOT a good idea to leave the USA when having an overstay on your record even with an AP doc.

6) USPS to the PO Box in Chicago is the best way to send, and costs the least.

Code I-485 "A" based on I-130,, and I-765 (C )(9 ) based on pending I-485.

B1 Visa holder. No need to say "Overstay" this is implied by noting the I-94 expiration date on the I-485.
