I was reading where you can bring your wife over sooner if she can find a work sponsor and get a HB2 Visa. She can stay for 5 or 6 months as long as she can pass an english test and can only work at the place that gave her the visa. This would be wonderfull if we can do it. If I can find a sponsor and she can pass the english test will they let her come over on a HB2 visa or will the fact that she was denied a K1 hurt our chances?

There is some work to be done by the employer to be able to use this type of temp. labor. It's not a simple as finding a local person to say they need extra help. They have to show that they cannot find enough workers locally. Plus if it's determined that she came with that visa with the intention of getting married to you it could cause you more problems.

I was reading where you can bring your wife over sooner if she can find a work sponsor and get a HB2 Visa. Believe it or not, I actually know a little bit about this. Unless your wife has some very specialized skill that cannot be found locally, this is just simply not an option. I happen to know two people who came over on HB2 visas (actually, I believe they were HB1s). One now has a Green Card, and the other has a long wait for a Green Card. But that is not the point. One of these people is a world class pianist, and the other is a talented computer programmer. Their employers went to bat for them for very specific reasons. It would seem doubtful that your wife would have the qualifications to get the HB1/HB2 visa.

I would be married to her before she came here.H2B is for general labor not college degree work we have serveral of those spots open here for maids, and other types of workers that nobody wants. She has experince in that kind of work. I read a few places on the web if your a resident or citizen and have family members in other countrys that would be a way to bring them over. She was planning on getting a job when she got here anyways and if she could spend the time with me before the interview that will be invaluable and easy to pass next interview because they will know she has a job here.

If the US government were looking for maids and other type of work nobody wants, then we would have alot of Mexicans from Mexico come over and we wouldn't have illegals. :whistle:

I believe that all new H1b and H2B visa's have been suspended until the economy has gotten better. I could be wrong but I think that is what has happened.

I just go back to what I was thinking when I started this journey. I should have just gotten Xuan a ticket to Mexico and let her come across with all the others.

Or just meet her in Canada and drive across somewhere.

But law way is the best way I guess.

If the law makes a determination rather or not Tran and I love each other then its no contest hands down she will be here. If it turns into some sort of sick perverted game where I have to deal with power mongers that could care less about the law then I think there is only a 50% chance we will get the visa.
