Timeline

I filed for a K-1 visa in 2008 for another girl. Soon after I filed we discovered the father of her child would not sign to allow the baby to come to the US. This basically ended the relationship so I cancelled the K1 request and also was notified it was cancelled.

I'm including a waiver request for my current fiancee.....anybody want to give me an example of a waiver request? Any help will be greatly appreciated.

For something like this, I would just type out a letter indicating that it is a waiver letter. Give dates and such for your first fiance. Include any A# and dates that you have or can remember, certainly her name, DOB, and country of origin. Explain simply what happened to the relationship, and indicate that you now wish to sponsor your now fiance.

You said you cancelled the first K-1 petition, so you may have some documents, case numbers, or something acknowledging the cancellation? Include that if you can.

I wouldn't think you would run into any trouble if you explain the circumstances as you basically described them here.

Right. Just a couple sentences under the heading of "IMBRA Waiver Request" added to your cover letter should suffice. Do add copies of any documentation indicating your first petition was withdrawn.

Are you sure the fatherz non cooperation would prevent mama from taking the child to US?

Was the child "legitimate or illegitimate?" (note, this is legal terminology)

Under Philippines family code laws, illegitimate kids under 7 are under mama's full control. She does not need the uninvolved fatherz permission to bring the kid to US.

Can you offer a little more detail why the father refused to sign off on the baby? Was it because he is involved in the childz life, or just wanted to be stubborn and make problems?

Did you offer any sweetner in an attempt to buy dadz cooperation? Letz face it, it happens that way sometimes

Hope you can respond to this, cuz some of us here face similar issues, and we can share experiences and help the community here.

I don't believe it will matter, since the OP has a new Fiancee.

Usually, cash works wonders with the 2nd parent to allow the other one to move somewhere else with the child (if they are not really in the life of the child).

But if they are actually "good parents" with the unfortunate issue of divorce/not being married, then it's a bit more difficult.

Both parents have basic rights to their children.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
