Travel here on normal VISA before getting K1?

My fiancee has an idea, and I'm not sure if it will work or not, so I'm posting here. What we're wondering is if she can come here on her normal visa until we get a response from USCIS about her K1. She'd then go back, do the song and dance packet 3 and packet 4, get the K1 at the embassy, and then come back under her K1? I don't really see any problem with this, but I'm just throwing it out there since you guys know a lot. Thanks!

She can come visit if she has another visa. As long as she doesn't stay longer than that visa allows, and has strong ties to her own country when crossing she'll probably be okay. She might not be able to stay until the petition is processed, but she's allowed to visit during the process. From the time you submit the petition it could take 4-5 months for approval before being sent to her country.

Make sure when she crosses the border she has strong evidence of her intent to return after her visit.

Yes, I traveled to the US while on the process of the K1, you can do that as long as you dont stay longer than the permission they give to you. Try not to give extra information at the Port of entry if they dont ask you, but always say the true, it is fine if they ask you

if you are on a K1 visa proces. But bring documents with you that make evident that you will come back when you said you will come back.

Umit just went back to Turkey after a two week visit here in the states.

They gave her 6 months on her B-2 visa to visit, and they knew she was doing the K-1.

She had her return ticket, letter from her boss, and a copy of our NOA-1.

She had no issues coming through. If it was possible for Umit to stay the six months, she would of, but like most people, she works, and they tend to take a dim eye to leaving for 6 months.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
