Hello,

Please forgive me I have not completed a timeline, but I please need some help. On May 10th we had our biometrics. At that appointment we met another couple there from Phillippine. We got to talking and learned they live near us, he was a citizen, and his wife was on a K1 visa and their situation was very close to ours, so we became friends. On tuesday of this week they received notice from USCIS that they did not meet the support requirements, and they called right away to tell us and were very upset. They said in that notice you must have $60,000 dollars proof to meet the support requirement, which they don't have. they meet the poverty requirement? I am worried for them as well as our situation that we will receive this same notice.

How can they say now after you were approved for K1 and are married you now do not meet support requirement?

What is the financial requirement for AOS? Is it 60,000 dollars? We are so worried. Please any help would be very appreciated.

The support requirement for AOS is exactly the same as the K-1 Visa except you show 3 years of back taxes rather than one. It is $16,000 for one year.

The support requirement for AOS is exactly the same as the K-1 Visa except you show 3 years of back taxes rather than one. It is $16,000 for one year.

You no longer need to show three years of taxes, unless it will help your case. This is noted in the special instructions for the form on the USCIS website.

Oh, and it may or may not be $16,000, depending on how big the household is. You can consult the HHS website for the exact poverty guidelines for your household size.

Thank you so much :blush: . Maybe they are just confused and so upset and we are too and made a mistake on the I864 form and just need to correct it god willing. I read on the requirements it is only 16,000 also, i could not believe when they said $60,000, but just wanted to confirm that it is 16,000 with some others who have gone through AOS and the Green card, from a K1 to put our friends and our worries to rest. We hired an attorney for our K1 because we were concerned about problems because of the region we are from. An our attorney never mentioned any problems about support to us. We are just waiting for our interview for green card now :whistle: .

I just wanted to make sure the support requirement for AOS and green card requirement is the same as the K1.
