Time limit allowed for RFE response

We filed AOS for me, my 11yr old daughter and my 9yr old son on January 12, it was received by USCIS jan. 14, NOA1s were issued January 20th, no Biometrics letters yet. I have been trying to check my status online and finally, I could now track my daughter's AOS and EAD and my son's EAD but my son's AOS, my own AOS and EAD still says it can't be found in the system. My daughter's AOS case says they have sent RFE January 29th but it has been almost 3weeks ago yet we still have not received anything: No RFE letter, No Biometrics letter either. :(

I know there is a timeline for responding to RFE, I am afraid we would miss it if we still won't receive anything by the mail soon. I just feel that my hands and my feet are tied, we can't do anything about this RFE till we receive the letter since we don't know what it is. I am worried about not being able to reply in time. Does, anybody know the length of time allowed for RFE response: from date of RFE issue to date of response? How long does it usually take to receive the RFE letter?

Thank you very much to anybody who could give insights.

Timeline

The best way to go about it is to schedule an InfoPass as soon as possible. Lately, people had reported erroneous messages on the USCIS's web site, but that's not a sure thing. Better be safe than sorry, and prevent any delays.

Calling for a service request at the 1-800 number will not solve anything (they cannot tell you what the RFE was about, because of privacy concerns), while an officer at the local service center might actually print the RFE again for you. You need to move quickly. They can also tell you how long you have to respond to an RFE.

11/17/08 : Application sent (I-130, I-131, I-485, I-765)

11/18/08 : Official receipt of documents stated on I-797C (Signature for receipt at USCIS was on 11/17/2008 at 10PM)

11/28/08 : NOA Received ( I-797C) for all 4 forms (forms issued on 11/26/2008)

12/18/2008: LUD on I-130, I-131, I-765

01/29/2009: Bio done

01/29, 30/2009: LUD on I485 and I765

2/10/2009: issued AP, valid 1 year for multiple entries.

2/23/2009: Got EAD card

3/8/2009: LUD on all applications. Shows approval of I131 and I765, still pending on I130, I485.

04/28/2009 at 9:30 AM: Interview. Told to wait 90 days for a resolution by mail.

05/01/2009: Card production ordered.

05/06/2009: Received approval NOAs for I130 and I485 (welcome notice, 10 years card). I130 still shows case received and pending.

06/18/2009: got the 10 years validity card. Process length: 213 days since sending the applications.

No RFE at all along the process.

10-27-08: Medical Exam

10-28-08: Interview! Approved!

12-20-08: U.S. Entry (POE Chicago)

1-2-09: Marriage

1-27-09: AOS package sent

2-3-09: NOA1 for I-485, I-765, and I-131

2-9-09: RFE received (need more income info. for household member)

2-24-09: Biometrics appoinment

2-25-09: RFE information sent back

The USCIS has issued a Final Rule, effective June 16, 2007, that gives adjudicators flexibility in determining the length of time a petitioner or applicant has to respond to a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID). Currently, the standard deadline for response to an RFE is twelve weeks. NOIDs must be responded to within thirty days. Under the new regulation, the USCIS will determine how much time should be permitted in any given case, with maximum possible time being what is now the standard response deadline. That is, adjudicators will set deadlines for both RFEs and NOIDs that could be up to twelve weeks in case of RFEs or up to thirty days for NOIDs. No extensions of time are permitted

Thanks Haole, this just gives me more reason to go for the infopass and DEMAND from the guy on the information desk to really open his computer and check my status.. we already went for infopass last week regarding our biometrics, he did not even check my case on their computer, he just told me to wait for another month and come back if i still don't receive biometrics letter. Had I insisted that he at least take a look on our case on their system, we would have known then that an RFE letter was supposed to have been mailed january 29th. :(
