I am an Australian Citizen, currently engaged to a US citizen and this whole visa process is confusing the heck out of me.

We're looking to get married in Australia, before going on our honeymoon and then moving to the USA (which would involve my immigration) and I'm not sure if I fit any of the options for any of the visas. Can anyone help?

After marriage, he will need to petition U.S. Immigration (USCIS) for permission for you to apply for a spousal visa (K-3 or CR-1). The process takes about nine months from the time he submits the petition. If you decide to come her as his fiancee, and get married in the U.S., then he can petition for permission for you to apply for a fiance visa (K-1), and that can take six or seven months.

So it basically looks like no chance of that happening. :( (also I'm the groom ;) )

I do believe after you've been married your fiance can file for you at a consulate in australia or one back in the states, I've included a link to the US consulate which tells of the options for visa's

But i believe she'll need to be a resident of australia for six months prior in order to file there. If not she can fly back to the states and file for you there ;)

Sure, you fit either CR1 or K3 visa. Since you're the groom and probably want to work soon after arrival, you'd want to take the CR1 path. Perhaps you simply weren't planning to wait as long as the visa process would take? Another option is for your her to wait in Australia until she qualifies to file the I-130 petition directly with a Consulate in your country. You can then remain together until the visa process is complete.

Facts are cheap...knowing how to use them is precious...

Problem is we don't really have that time, she can't be without work for 6 months and being seperated from eachother for 6 months is a little too reminicent of Berlin for my liking.

Looks like I'm going to have to go the K-1 route, that's no good I really wanted to have the wedding as a goodbye to friends & family here.

Marrying a foreigner requires adjusting to the practicalities of immigration law. You can certainly have a celebration before you leave.

I totally understand how you feel.... it sux... CRAZY PEOPLE THAT ARE IN LOVE!!!!!! hahaha
