I do have one more question about the I864 and the I864-A....

my stepfather will need to fill out an I864 as I do not have enough income to support my husband, I am also having my mother fill out the I864-A as I would like to use her income. On part 2 of the form there is the "Sponsors Promise", do I fill that out or does my step father?? I would think my stepfather does because he is in the same household as my mother?? am I correct ?? That would also effect how she fills out the "Relationship to Sponsor" does she say Parent or Spouse? :unsure:

I'm sorry that I can't help you because I'm not sure of the answer! Have you had your I-130 appointment at the Embassy yet? My husband and I went yesterday and they allowed us to bring the Affadvait of Support documents that we had so they could go through them and answer all of our questions. We are not using the I-864 A though. They also suggested that we email them if we had additional questions. Have you tried contacting the embassy?

Sorry! No we do not, so as I understood he would need to fill out the 1-864 as well. Plus my mother (who does live in his household) is filling out the I-864A because we need to use her income as well. I'm just confused as I know I am the petitioner/main sponsor, but the form states "I the Sponsor..." just not sure if they mean me or the step dad.

We are going Monday (23rd) to the Amsterdam US consulate to file our I-130 I was just preparing everything making sure we can move along as quickly as possible! I'm not so sure the consulate here would be so easy going here but if it comes down to it I will try! thnx!

Ok! Here is my understanding...

I-864A cannot be submitted as a standalone application. It has to be submitted with an I-864. In this case the I-864A is being submitted in conjunction with the I-864 being submitted by your step-dad (as they are in the same household). So I would answer relationship question as 'Spouse'. Now if you were all living together in that case you would have submitted an I-864 and your step dad and mom would submitt I-864A each and in that case the relationship would be Parent.

Another option you have is to put "Parent to primary sponsor and spouse of additional sponsor" to cover both ends.

Hope others can chime in and confirm.

Guess I'll have the step-dad sign it with my mother. I'll try to email the consulate before we finalize everything.
