AOS joint mortgage question

Hi

My wife has lived in her current home for about 12 years and has had her current mortgage for all of that time. Until summer last year, her ex's name was on it too because neither was in a position to buy the other out. He died last summer and his name was then removed from both the deed and the mortgage. As it stands today, my wife's name is the sole name on both.

We've been in touch with the mortgage company and in order to add me to the loan, I must qualify, credit-wise. Now that's just not going to happen. At this point, I've only had my EAD a fortnight, am waiting on my SS card in the mail and am obviously still unemployed. There's no way on earth that I'll meet the credit requirements for a mortgage. My wife explained this to the man on the phone who said basically that was the only option. All this is exactly as I expected it would be.

The man at the mortgage company is sending us a form that we can file with them for a small fee and they'll then credit check me (the outcome obviously being a decline). My question is will the letter declining me credit be sufficient to explain to the IO at any future AOS interview why we don't have a joint lease or mortgage? Obviously in combination with other proof of 'intermingling' such as joint bank statements, utility bills paid by checks I wrote, and so on and so forth.

At the moment I'm at CSC so I'm hoping for approval sans-interview but we want to cover all the bases just in case... Surely it can't be that unusual a situation where the USC already has an established mortgage and the foreign spouse can't build enough credit by interview to added to it?

Not having a joint mortgage is not going to get you denied for AOS. There are many people who have not been able to include their new spouse on the Mortgage or title deeds for lots of reasons. so dont worry,

If you are asked about it at the interview then tell the truth just as you did in your post. Just make sure you have other joint evidence like utility bills and join insurances and joint finances.

Most evidence is needed when you file to remove conditions 2 years after you get approved for AOS. At the AOS they are looking to see if you have started to co-mingle your lives.

Just keep collecting evidence of your joint life and remember to be truthful at the interview and you will be fine.

Timeline

and from a financial perspective, you are really wasting money trying to add yourself to the mortgage itself, the title is one thing, but not the mortgage.

There will be fees incurred simply for adding your name, and then you are also both of your name credit wise to a single loan. In terms of future investing, if you ever wanted to buy a second house or a investment property, you will find it easier to buy it with just you financing it and both of you on the title.

Don't commit financial suicide just for one extra piece of evidence which really won't matter that much anyway.
