My husband is from Mexico and I was born in the US. We have been married for 2 years. We were married here. We went to an immigration lawyer to see if there was any way to get him a legal status. He didnt give us much hope. I am new to this site and need help. I am not sure if the lawyer is being truthful or if there is something else that we can do. If anyone has any advice please let me know. thanks

Is your husband DOCUMENTED as being in this country????

If Immigration KNOWS that he is here (illegally), then he's dead meat (i.e. as soon as found, he will be deported and BANNED from this country for TEN years).

However, if they DON'T KNOW that he's here, he should get OUT A.S.A.P. without them knowing (easy enough), and then you should file a I-130 and I-129F with Immigration to bring him here legally (as long as they have NO history/documentation of his having been here illegally, he should be approved. If they DO have histroy/documentation of his having been here illegally, then it's 10 years exclusion).

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

he has been here in the US for years. there is documentation if you consider his past tax returns. im just new to all this and have heard alot of different stories and thought that other people in my situation might have some answer, or better info for me. thanks!

I would NOT suggest him going home and trying to "hide" the fact that he was in the US as someone else suggested.

I have read in local paper ( California being home to people that came in without inspection) that there is a blackmarket for valid SS number. They use someone elses number. Not sure how the real person doesn't find out.

First visit:2007-09-12 to 2008-09-23

Consulate Received : 2008-04-28

Interivew date : 2008-08-07 CO asks inappropraite questions

His father died: 2008-08-18

Retain Marc Ellis 2008-09

Visited Nigeria again: 2008-11-12

My ex-husband was in this exact situation. But we were married less than 2 years before we filed papers. And it was way back in 1993 so I'm sure things have changed a lot. He had no problems and he handled all the paperwork and all the fees, so I can't really say exactly what papers, I just signed them. I just can't remember and I don't have copies anymore. He never got in trouble or deported.

But I did have to high-tail it to Mexico after he was interviewed. They didn't believe him and wanted to see me and pictures. I can't believe we were too stupid to send pictures with him. But then again I wasn't too happy with the marriage already, so didn't care as much as most people going thru the process.

I even divorced him before the papers were final. But he still got his greencard. Boy, was he angry when he thought I had screwed him out of the greencard. We had a young daughter though. And I did go to his AOS interview with him.

Don't remember much just explained the divorce and was insulted by the officer when she stated that my daughter didn't even know her Dad, which was a crazy lie. She was about 1 year old and ran around in the new environment like a little circus monkey. She wasn't paying attention to questions, like "Where's Daddy?"

I'm sorry I guess this wasn't much help.

My brother-in-law owns a roofing business and recently "ran" all the SS of his workers. One came up as a 98 year old man. I doubt that gentleman was checking his credit report or even alive.

thats not the documentation that they are asking.. The documentation they are referring to is a visa or any type of entry permit. If he came accross the border visa "EWI" or entry without inspection then you have "for now" no hope of legalization. As the law is right now if you want to legalize your husband you must file the proper petitions then your husband goes back to mexico and waits for up to 2 yrs for which when he leaves he will be banned for 10 yrs in your husbands case. your husband will go to his interview be denied because he was illegal with no papers you will have to quickly file a waiver of inadmissability and prove extreme hardship to the consulate that waiver takes 6 months to a year more once processed if approved your husband will get his green card or visa and he then can come to the states... Its' a depressing grueling and very expensive ordeal and even the thousands it costs and the long waiting of seperation you are not garenteed success. You will need a very good lawyer. That is your only hope to get papers. Your other alternative is to wait for an amnesty. Just hope he doesn't get a deportation order now or in the past.

If he came in with a visa or entry permit that qualifies you can petition for him and he can adjust status and stay here while it is processing. but that all hinges if he has a qualified visa expired or not. and as long as you are a usc.
