Note on Where to File:

Give the completed affidavit of support with all required documentation to the sponsored immigrant to file with either:

a Consular Officer with a completed Form OF-230, Application for Immigrant Visa and Alien Registration, or

an Immigration Officer with a completed Form I-485, Application to Register Permanent Residence or Adjust Status

This is on the website at the bottom for the AOS on where to file....I thought I was filling out the I-864 with all the necessary paperwork (tax returns etc) and then sending it with the cover sheet for the AOS paid bill to the address given on that page....What is that part about the OF-230 and filing it elsewhere?

Just when I thought I was beginning to understand!

I-864 is used in 2 different situations.

1) It is filed to NVC for IMMIGRANT visas like IR-1 and CR-1

2) It is used when a K-Visa or other NON-Immigrant adjusts status (I-485) in the USA.

Your situation is #1

The I-864 is for sponsoring a GREEN-CARD.

Ahhh thank you! So when my husband goes and gets his visa (fingers crossed) he will also then be considered a permanent resident? Or do we file for the whole social security shabang once he is here and THEN he is considered a resident? (we've been married for longer than 2 years)

As soon as a CR-1 or IR-1 visa holder enters the USA they are a green-card holder, and are considered to be a resident.

Give SSA a few weeks, and if a SSN card does not arrive, then go visit the SSA office and order a card.

If married 2 years before entry the visa will be treated as IR-1 and should be issued a 10 year green-card.
