US Permanent Residency Question...

Timeline

Hi all,

A possible scenario -

Leave the UK and Arrive in USA on a K-1

Get Married (yay!)

Apply for AOS

Hopefully Receive Permanent Residency/Green Card

Now my Questions based on this are -

1. Do I need to stay in the USA for a minimum amount of time before I can go back to the UK?

or

2. Can I go back to the UK for 3-12 months and stay there, or does that affect my US permanent residency status?

Those questions are answered on the USCIS.gov page. I believe that you cant' be out of the country for a year... defeats the purpose of permanent residency.

You can go to the UK ( in your case) after you obtain your GC, but anything longer than a year, and you're going to have to get a re-entry permit to come back to the US. This is going to affect your timeframe insofar as applying for nautrualization down the line as well.

1) no, not once you receive the GC

2) Yes, but be careful on long stays out.. re-entry permit required at 12 mos. in addition a couple of 6 mos stays out in a short period of time could hurt you as well.

If you will be absent for more than one year, obtain an advance parole before leaving.

You may travel immediately upon receipt of the green card. For the rest, Google, "maintaining permanent resident status".

Facts are cheap...knowing how to use them is precious...
