Hello!

I am currently trying to bring my wife (Japanese citizen) to the U.S. I am a U.S. citizen.

Last week, we received the Notice of Action, informing us that our petition (I-130) was approved.

Now I'm working on the I-864 form. However I ran into a brick wall and don't know how to move forward.

On page 4 section 25, Federal income tax return information, I have to write down my 3 most recent tax return.

The Problem:

• I have filed my taxes for 2005, 2006, 2007, but my annual income was below the poverty line because I was a student.

• For the last year, I've been employed and just received my W-2 for 2008, which reported my income being well over the poverty line. But because I haven't filed my tax yet for 2008, I don't have a tax return for it.

The Question:

• Would I still be able to write my 2008 income in section 25 as the most recent tax return or do I have to write my 2007?

• Will I still be able to sponsor my wife without a co-sponsor?

• What should I do with my 2008 W-2 form? Is there anyway to use it as leverage?

I would greatly appreciate all of your input. My wife and I have been away from each other for more than a year and we can't bare to be away from each other longer.

I suggest you file 2008.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
