Hi all,

I'm a bit concerned/confused on which name to file my I-130 with and what to send as proof of who I am. Here's the details and reason for my concerns...

My birth certificate, which USCIS requires, naturally has my maiden name.

I was married for 27 years, so everything I have is in my previous married name, including my passport and that is how I signed my marriage certificate with my husband.

I can't change my passport, ssn, bank accounts, etc. until I get my marriage license (any day now).

So my questions are:

Do I wait to file my 130 until I get my passport and stuff changed to my new name (I hope not)?

Do I need to send my first marriage license as proof of changing my maiden name (on my birth cert) to the name I signed on my current marriage license?

I hope I'm making sense. Thanks for the advice!

File using your current legal name. Yes, use marriage certificates to document both name changes from maiden. What you need to file is the marriage certificate, not the marriage license, even if they appear on the same sheet of paper. Sounds like what you're waiting for is what you need but a "license" does not certify you got married, only that you were licensed to do so. In most states the license precedes the marriage but some number of days.
