Oh man, this is so confusing. I don't even know where to begin. My husband was born in Colombia and was raised there but he came to the US for a while, stayed here a year or two and went back, and he's been living here now for the past 7 or 8 years. He has a daughter in Colombia that we would like to bring over. He had her when he was really young(not married to daughter's mom) and never filed the birth abroad with the American Embassy, so we don't know what to do now. It's extremely overwhelming! Please please please help us out!

does not sound like he was a USC when the child was born therefore no CRBA would have been filed... It appears he must file an I-130 for the daughter to get her here...

He will most likely have to file form I-130 for his daughter. It's not a difficult process as long as you try to get as much info as possible, just make sure to read the GUIDES here on VJ found on top the page.

There is also another member who's a US citizen, her husband is Colombian and they brought his children over via the I-130. She may be able to help you with any questions you may have.

That would be me, if the process you need to take is the I-130 route get it filed ASAP. There are many shortcuts now That were not known to ne when I did the process. The process to bring my 2 step kids here ( I am the USC ) took about 9 MOnths and this can be shortened some with the on line payment process at the NVC. You can see my timeline for the boys information.

Why is it that the only one who can stop the crying is the one who started it in the first place?

5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well

And yes, I wish I had had the option to pay all those fees online back in the day. It's definitely a lot faster and hassle free, that's for sure.

So even though my husband was born here in the US he will have to petition her using and I130 form?

What are you saying? You started off this thread saying your husband was born in Columbia.

WHERE WAS YOUR HUSBAND BORN?

I thought you had said your husband was born in Colombia and then clarified that he was a US, I guess we assumed he became a US citizen after the baby was born.

If he was born in the US then he may be able to give her US citizenship by filing a Consular Report of Birth Abroad with the embassy, but only if she's under 18 years of age. I believe this is done by filing form DS-2029 with the embassy. He needs to contact them to get more info.
