Hi all,

I married my chinese sweetheat in July 08. At the ceremony we were given little red passport sized books that I was thinking was our marriage license. Am I correct on this assumption? USCIS has sent me a NOA stating that it appeared that the marriage has not beed registered. Also, she has been married before, and I have sent in a divorce certificate. USCIS is asking for a divorce decree, is there a difference?

in california, the license has to be filled out (as to the date of marriage, signed by witnesses and the person solemnizing the marriage) then mailed to the county recorder to be registered with a certain fee. it usually takes 4 weeks before you get your marriage certificate.

divorce decree is the document that indicates the judgment that the marriage was dissolved - signed by the judge, usually in a pleading format or judicial council form.

Sept 8, 2008 - mailed N400 application

Sept 9, 2008 - NOA

Oct. 2, 2008 - Biometrics

Jan. 7, 2009 - Interview

Feb. 26, 2009 - Oath Taking Ceremony - Los Angeles Convention Center

March 4, 2009 - Applied for U.S. Passport at the Post Office

April 6, 2009 - Received U.S. Passport in the Mail

You would need your red book and her divorce decree translated at the local Notarial Office. (Gong Zheng Chu) The red book is the marriage certificate but you'll notice the only thing in English is your name. There is no "marraige license" in China.

Facts are cheap...knowing how to use them is precious...
