My wife's greencard will expire in 90 days. She recently had her car stolen :(

Inside the car was her purse and greencard of course... while we have recovered

the car, her stuff is long gone.

Since we have to pay $545 to "remove conditions" and renew the card anyway

(it expires in 90 days) I'm not keen on paying the $370 to replace a lost card.

I'm hoping we can jump right to the 751 form.

Here's my question. On the 751, it asks for a copy of the front & back of her

greencard. We do have copies of the front of the card, but I can't find any copies

of the back (I think it copies as a black square anyway). Will our application be

approved without copying the back? Even if we get approved, will they end up

asking to see the card at an interview or biometrics appointment?

VSC is taking almost a year for I-751 approval.

CSC is about 6 months.

Long time to be without a GC.

I'd send in what you have and file the I-751 and file to replace GC also.

And how long for GC replacement?

Based on my experience, it took at most 6 months before I received my corrected GC (sent it back because of an error from them).

I hope you have filed a report about this with the police and had an affidavit of loss in your position as proof, just in case, you know the "identity theft" thing. Who knows what they (who got hold of her ids) gonna do about it. I agree with Haole though, that it is safe to file a replacement of her GC.

Better yet, call USCIS so they can advise you on what to do.

Three things -

1) The back of the greencard is not just blank - it does have a barcode and a number (I don't know what the number is for?)

2) You are probably OK especially since most people are not interviewed for the removal in any case

3) Never carry the greencard on you if you have a driver's license - that's what my wife does - the driver's license is primary proof of her legality here (as far as policemen, govt. offices etc. are concerned - many of them do not recognize greencards as they do not understand it). Even I came to US as an immigrant but after a few weeks when I had my driver's license, I stopped carrying my greencard till I traveled or finally for the citizenship interview and oath (where they take it away).

Let her visit local USCIS District Office with police report and I-797D approval notice came with green card.

They will instruct whether it is required to file replacement card or not.

Also she may need to get temporary 1 year I-551 stamp on her passport since she doesn't have Green Card.

3) Never carry the greencard on you if you have a driver's license -

This contraverts USCIS law and could place an alien in a position to be charged with a misdemeanor, subject to a fine or worse!.

Section 264 of the Immigration and Nationality Act provides that, "Every alien in the United States … shall be issued a certificate of alien registration or an alien registration receipt card in such form and manner and at such time as shall be prescribed under regulations...." It also states, "Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him.... Any alien who fails to comply with [these] provisions shall be guilty of a misdemeanor" and may be subject to fine and/or imprisonment upon each conviction. The specific requirements and procedures for applying to replace a permanent resident card are included in the Code of Federal Regulations [CFR] at 8 CFR § 264.5.
