Hi.

I'm italian and I met my girlfriend online more than 1 year and half ago...is not the normal kind of experience that U could have cuz from the moment that we met, the relationship is so closed that we spent ALL night togheter sleeping with the cameras on and the only time that we'are not spending togheter in camera is when we go to work and when that happen we call each other pratically every hour....just to let you understand how closed we are...the feelings are strong and so the time to meet came and is going to be in may or june.

I would go there using my VW, spending two mounths together 24/7 and afther get merried (I asked her out already)...I know that sounds crazy and that I sould had to go earlier there even to visin or know each other but her situation is not good enought to let me do this because her ex boyfriend (she left him before that she met me) could become danger if he could know that she met me and I'm not with her for a while...I was scared to make her in a bad situation so I took the decision to move there directly so that I can take care of her without make her risk anything.

Anyway...this is my story...made real fast obly but...my question is: how I could make it true?

I go there without say anything about my intents to get marry, I marry her afther 60 day (around) and we ask about the AOS but....how long is going to take to have the AOS? Could I be kicked out and leave her without protection?...please help me because I'm very confused.

I forgot to say that she's coming from California, exactly in the king's county where there are a lot of immigrants from Mexico, I love her and I want to be her husband so bad that nothing could stop me. We was planning to start here in Italy but her son (she had him with her ex) and the job in Italy are stopping me because I cannot let her leave her son and I dont have a good job here even if I can make a lot of good jobs that are requested a lot in the USA. I can fix computers, I can fix cellphones, I can cook and make a lot of other stuff but we have a big crisys here that is making pratically impossible my future here.

You cannot plan go to the USA on the visa waiver program, marry and stay there- that is visa fraud and you could be banned for life. You also need to have met in person within the last two years before you can file.

You will need to apply for a visa to enter the USA; there is the K1, which is a fiance visa which will allow you to move to the USA and get married there; it is the fastest of the visas, but not by much. Or there is the CR1/ K3, which is for married people; you could have her come on a holiday and get married in Italy, then go back to Cali, or you could go for a holiday to Cali, get married, return to Italy and she files (the CR1 results in immediate green card, so you could work right away once you are in the USA), as it is the staying in the USA that would be visa fraud, not the getting married

thanks penguin_ie...so what are u trying to tell me is that if I go in the usa and happens that I meet the girl of my life and I want to get marry without come back nomore in my home country...I'm not able to do that?...because I hear that this is possible...even at my girl the court in her city told her that the only thing that we need to do is get marry and afther pass overthere to make any requestions (I think the AOS) and I'll be able to do stay there...the only think that the said is that my VW mustnt have to be expired cuz if that will happen than I'll have troubles. A lot of people made that in her city...a lot of her friends evem her aunt (that is the one that told her to go to the court) made that already....the thing is that I dont have to have my VW expired and that I'll have to wait to move from the USA untill my situation will be not solved.

I'm not going to say that I'm coming there to get marry or that I'm going to meet someone that could become my wife...I'm coming for vacation.

We cannot condone fraud, which is what you are planning. Even if others have done it, it doesn't make it legal.

The local courts do not have the expertise or the jurisdiction to comment on this matter. Your local U.S. Embassy would confirm that your intent is fraud. I suggest you contact them, if you care about the legitimacy of your actions.

People who use the immigration system in a fraudulent manner only make it worse for us folks who do so in a legitimate, honest manner.

If I'm asking here is because the States are so hard that is pratically impossible undarstand what to do...that was made from people that was coming from all over and now if I want to fart in my hotel's room in Miami I must have a Visa.

1: There are a lot of rumours and miss-information around; don't believe everything friends tell you. People on VJ are better informed than most, because we have been through this.

2: No; if someone made it, that means they got away with it. They'll have to look over their shoulder for the rest of their lives. Many more got caught.

3: Assuming you do everything right, it can take as little as 6 months, though 9-12 month is more usual at the moment; check out the timelines on here for more info. Costs hover around 2000 dollars for fees, medical, getting documents etc, but it does depend on the country. . You don't need a lawyer, save your money and just look at the guides here.

I understood perfectly, now I need only to understand how to make it without make her risk her life. I'll try my hardest to find the way to stay and it's not because I dont want to respect the rules but just because I'm too much scared from that man.

and some personal advice which I hate giving ever, but I feel is needed - you have never physically met the girl, I suggest that you bring her over or visit her (without getting married straight away) and just see what the relationship could be like, you are making a big decision that is going to change your life forever, at least give yourself the chance and benefit of the doubt that you are going to be doing the right thing by choosing this person.

If I did not make it is just because I'm scared to risk her life...we have this 3 mounths to take this decision but if we feel ready I want to know if we could make it true or not and in witch way.

are 16 mounths of constantly, 24/7 time spent together...yes it's online but are not the feelings or our way to be that are giving us doubts...I'm sure like she is that we are made for each other...and for me everything could be more easy bringing her overhere but she cannot leave the States cuz her ex could act stupid using her son or waiting for her to come back there by herself.

In terms of her risking her life: no one other than the two of you needs to know you are applying fir a visa until you are over there and married, so no problem there. Also make sure she has a protection order against the ex.

I am not sure how the link would apply to you? It's about adjustment of status after you arrive with a fiance visa.

Can i ask to have a fiancè visa without meet each other on person?...for me would be perfect....if not I have to go ovethere just to show off or to get marry and come back waiting that she could call me there with I-130...but in that link I read that there are chances to be legally in the usa if I get marry in few days and make the AOS before that my vw is going to expires...I just want to find a way to dont leave her by herself because her ex has got always the rights to get hold on her because of her son...we are not rich enought to pay lawyers and I'm very carefull to her...I want to have her in good healt and I dont want to be cause of problems for her.

The difference between your situation and the one in that link, is that you are outside the US and *planning* to use the VWP to immigrate, whereas the other poster was already in the US, having genuinely entered for a visit. What everyone has been trying to tell you is that to plan to do this in advance, lying to the officials at the POE is wrong and visa fraud, while *genuinely* entering for a visit and then later circumstances changing so you decide to stay is ok. Sure you may get away with it, but if you are caught out in your lies, you may be refused entry at the POE or later denied your adjustment. If you were asked for proof that you intended to return, how will you answer if you really left Italy not intending to come back? Those who genuinely changed their minds will have that proof.

No, you can't apply for a K1 without having met her. I'm sorry about the situation with her ex, but how about she makes a trip to Italy to meet you and you get engaged, then file for the K1 and when you get it and enter the US, you move far enough away from the ex for it not to be a problem? She could bring her son, or else have relatives/friends look after him. The requirement is that you met each other, not that you visited her in the US. No one needs to know she went to Europe to see you, all she has to tell them is that she went on vacation, then surely no problem with the ex. Like the others said, if he is really that bad then she should look into a restraining order - yeah not perfect but better than nothing,
