Aww man.... I wasn't supposed to post about anything important today because Elena's visa was APPROVED!!! Today was supposed to be sunshine and puppy dogs....

BUT THIS..... This I've gotta post on!

Locking them up indefinately....something wrong with that picture, at least to me. I mean, doesn't our tax dollars pay for those that are locked up in the prisons across this country? :unsure:

Locking them up indefinately....something wrong with that picture, at least to me. I mean, doesn't our tax dollars pay for those that are locked up in the prisons across this country? :unsure:

not indefinitely - locking them up till they can be deported. i'm sure you've read about that arrest of about 1100 illegals this week, where about 100+ were previously arrested and turned loose, and had to be picked up again cause they didn't leave.

HOUSTON (Reuters) - U.S. customs officials arrested more than 2,000 illegal immigrants, gang members and other fugitives in a nationwide sweep, the head of the U.S. Immigration and Customs Enforcement agency said on Wednesday.

(of that 2,000+)

Others arrested included 146 who had convictions for sexual offences involving minors, and 640 were fugitive aliens who had been issued final orders of removal by an immigration judge and had not complied.

The UK government quite famously tried that in Britain a few years ago with asylum seekers (our version of the illegal immigration problem). After a few months waiting to have their case heard there was a mutiny, the detainees burned down the prison and escaped into the countryside. Caused quite a scandal at the time..

Unless I'm reading this incorrectly, it seems like the men in the class action suit weren't P'd off because they're being held on visa violations and the like, it's because they were being "detained" as terror suspects post-9/11.

I'm sure they're probably making the connection (after being here in the US for a while and getting used to some of the "good life") between being detained in NY and some of their fellow Muslims being detained at Guantanamo Bay.

There's supposed to be some protection from being "detained" without charges and legal counsel. Granted, that protection applies to USCs and permanent resident aliens only, but it appears the men are accusing the government of doing what it does so well....

Doing one thing and calling it another, detaining these men while investigating them for terrorism links while saying they're being detained for visa infractions. Kind of sounds like invading a country and stealing their oil while "looking for weapons of mass destruction."

IMO this is a rather distasteful aspect of racial profiling - at best its on the line where an (arguably) common sense policy becomes racist and highly discriminatory.

This part I find quite interesting:

"It doesn't seem to limit the motives the government has to have in being slow in removing them; it could even be just basic neglect," he said.

So in effect the policy protects government bodies from bureacratic incompetence, people could be held for much longer than they need to be, at additional taxpayer expense - even if the delay is caused by some government department dragging its feet or simply not doing its job in a timely manner.

That is exactly the point of the lawsuit. Noone involved is angry at being deported after being caught for illegal residence, but because they were detained for being Muslims. That, IMHO, is a huge difference and it smacks of a similar strategy back in the '40s when the government detained Japanese Americans.

Note that all this happened in the months post-9/11 and not last week. Many of these suspects were detained for almost a year without being told why they were held and when and if they would be deported. They were also not granted access to legal counsel.

When I read the article I was wondering if it was that easy to track down illegal immigrants why wait until after 9/11 to act against them???

Except they're NOT getting flights home. If we're going to detain someone, even someone here illegally, they should be afforded due process and either given access to the legal system to contest their detention or go through the deportation process.

What worries me here is when we detain people indefinately without access to the legal system, how are we suppose to let all of the checks and balances work that are suppose to protect the innocent. What if someone gets swept up who is in fact not guilty of anything. How are they suppose to contest it if they're locked up indefinately?
