They didn't open the sealed envelope!!

I am about to file AOS and little stuck on the medical requirements. We have the photocopied DS-3025 from the medical examination. So I need to take it to a civil surgeon and hopefully they will make the i-693a?

At point of entry they did not open the sealed brown envelope! They just let her in with her I-94 on the visa. So now I have this sealed brown envelope which was supposed to be opened at the POE.

Do they usually open this up and give you something useful from it like medical papers? I was reading that they are supposed to take some medical papers out and forward them on.

Should I send this in with my I-485 or should I keep it and show it to my grandchildren? I suppose I can open it now since there is no point in keeping it sealed, or will they see that some papers were not entered at the POE and still need this signed?

Do I still need to do the I693 or is there something like that in the brown envelope? If I send the brown envelope still sealed with my AOS i-485 packet will I get extra credit?

thanks,

Agd

I would vote for the extra credit!

YOU NEED TO MAKE AN INFOPASS APPOINTMENT AT YOUR LOCAL USCIS OFFICE NOW or CALL THE CBP AT YOUR NEAREST INTERNATION AIRPORT AND ADVISE THEM THAT YOUR WIFE DID NOT HAND IN THE SEALED ENVELOPE WHEN SHE ENTERED.

You must sort this out and DO NOT OPEN the envelope. It contains your wife's immigration file and is needed by USCIS to continue the immigration process.

Thank you for this wise and obvious advice! I should have done that a month ago! Thanks for this! I just made the appointment and will get this cleared up.

I hope you can sort this out! Surely even if your partner forgot to hand it over at the PoE, the CBP guard should have 'reminded' her? Well you'd hope so, wouldn't you? Please keep us updated as to what the IO says at your InfoPass appt.

Anyway, this thread raised a question in my mind that I'm curious about. Obviously a major reason for the 'do not open' requirement is to protect the integrity of the files inside but are the contents actually 'classified' in any way or is preventing alteration the sole reason? Does anyone know? I have an enquiring mind

I have the same problem. My husband entered in Los Angeles on Dec 10, 2008 and had his envelope in his carry-on bag. All he said to the officer was "immigration". He didn't show them the envelope and they didn't ask for it. So now it is sitting in our closet. Where do we call to make this appointment to turn it in?

An "infopass" appointment

http://infopass.uscis.gov/

I will go on thursday. My fiance entered on 13 Dec, we got married and now I need to file her AOS within the next few weeks. It contains some papers and some medical documents which they are suppose to forward. Then when you do AOS they combine the medical documents with your application. I am hoping it has the medical things properly so I don't have to mess with the I-693 and finding a cheap civil surgeon.

Got our INFOPASS appt for March 2 (the soonest available) in Los Angeles. First I called their "General Information Line" at 1-800-375-5283 and everyone spoke Spanish. When I ask to speak English they wanted to know why I had called the "Spanish Line". (because that is the only #listed on your website!!! ) Then every time I explained my problem the info person said "Oh My Gosh!", "Oh No!", This is really bad!!!". Then transferred me to the next higher supervisor. Finally the last person said I had to turn over the envelope to someone but she wasn't quite sure where. She suggested that I take it back to the airport but when I asked where is the office at the airport she said she didn't know but said "whoever takes it should give you proof that you turned it in because it may get lost." :o

At this point I just went online and made the infopass................Now I need a drink.

:wow:

Yikes. Sounds scary. I think that the misinformation line gave you sound advice though - DO NOT turn that envelope over to anyone unless they give you a signed and stamped receipt with the name and number of the person who took it from you. That way, you're covered if later on they say "we don't have your visa file" and you can say "I gave it to XXXX, at YYYY on ZZZZ; here's a receipt to prove this fact."

Clearly you need to be very careful about how you turn it over to USCIS in what seems to be very rare if not unique circumstances...

Call the airport and ask for Customs and Border Patrol, explain to them what has happened and they will be able to tell you where their office is in the airport and you can take it to them. Make sure you get a receipt for it. Calling the 1-800 line is a total waste of time.

I hope they gave her an I-94.

When my husband entered the US they took his brown envelope but failed to give him an I-94.

This is an unusual story, but it probably happens more often than any of us think. Did she enter at a smaller airport?

I ask because my husband entered the US at Dublin, which is pretty experienced with taking K1 entrants. But still our officer made a mistake. When we realized we had no I94 (about three days later) we knew we couldn't easily go back to Dublin and have them give us the I94. So we went to Pittsburgh, our last airport of travel. The commanding officer took care of issuing a duplicate I94. While he was helping us, he was talking to the two other officers on duty and explaining the K1 visa to them and the steps to take when inspecting a K1 entrant. My guess (at that time) was that Pittsburgh probably didn't see a loads of K1's.

I think John is right. The envelope is supposed to be opened at the point of entry and inspected by the officer. There may be some paperwork they need complete after they have inspected the contents.

For all of you waiting on the edge of their seats, we went today for an infopass and after the long drive and wait they unclimactically told us to go back to the airport and talk to the duty officer. The man did say it was very important and she won't get a green card without it.

After another wait the official looking lady took our envelope from us and said it would be mailed to the USCIS.

So that's all. If this happens to anyone, save yourself an Infopass and just go back to the airport.

This was Dulles washington DC, quite a big airport!

OK, now to go

Thanks everyone,

Ankur

This is not your wife's mistake. CBP made the mistake. No worries. Just take it to the local office.
