K1 Petition Approved - what can i expect next?

Timeline

Hi guys,

Had a funny twist happen with this petition, we received and RFE on Dec 23, 2008. I am pregnant and we had decided it would be best if we just give up on the whole K1 and have my fiance move here because I am having the baby in Canada.

Funny thing is, on February 4th my fiance received a letter from USCIS, stating that the petition has been approved. The weird thing is we didn't even bother sending more information to prove our relationship when we received the RFE. How did they go from RFE to approval????? :blink: especically with no additional proof.

My fiance is coming here until the baby is born, and we might just end up doing the Canada paperwork for him to stay here.

What happens next with the K1? What will my fiance receive next? I haven't received anything from them.

I don't know if i want to stay here or persue the K1 - the waiting and money is going to take its toll, espeically with a baby coming..

The approved petition will be transferred to NVC. NVC will assign a case number and send it to Montreal or Vancouver. The consulate will then send you a packet of instructions.

That's really interesting that you got an approval when they were waiting for the RFE to be returned. :blink: Who knows sometimes how USCIS works!

What happens next is that your petition as YuandDan stated will be sent to NVC and then to Montreal where you'll get a Package 3 from the Consulate. You'll have to answer some questions, gather information, send the information back to Montreal and then you'll be put on a list for an interview. I don't know how long Montreal people are waiting on interviews right now, but I think it would be safe to say you probably won't get an interview until this fall or later.

If your fiance will be coming up to Canada until the baby is born, and I don't know his financial situation, you might have a hard time meeting the financial part of the visa process to move back down to the U.S., I don't know...can't say because I don't know if he has money, or assets, or a job.

If you're thinking of him immigrating to Canada, then I suppose you should just not return the information to Montreal, maybe even cancel the visa process and then you can pursue the marriage based visa avenue if and when you three ever do want to move back down to the US.
