Today i received the following message via email, any idea what they mean by "requesting initial evidence in this case" I called USCIS (800) 375 – 5283 and they told me that i need to wait till i get something in the mail and they also gave me the same "status information"

Any idea, why they are asking for this information - this late in the filing process?

I got this same message on my case. when I got the mail it stated they wanted the original copy of my divorce papers from previous marraige. I got that and sent it to them and the process resumed. I was approved 30 days later. good luck

Was that from USCIS or from National Visa Center? If they are requesting for original, i only got 1 original copy of marriage certificate. I read somewhere that after the approval, i need to send most of these documents again to NVC and some of those docs, they need to see the original.

this letter came from uscis. your request could be for something totally different. all I know is the faster you get the info back to them the fster you case will resume. as far as having to send docs again I have read that to but I have also read that they will not be needed until your interview. I have copies of everything with my wife in Romania and I will be there for her interview

USCIS needs copy of the documents and NVC require all the documents in original (with translations in english if the originals are in foreign language) except copy of the biographic page of beneficiary, copy of 3 yeards of tac return with copy of W-2 and/or 1099, copy of pay checks. I included 2 1 /2 months of recent pay checks.

Keraliany just wait for the RFE and respond back. Your case had already in review and will be approves as soon as USCIS receives it.

KeralianNY - They person reviewing your case is probably looking for additional information regarding something in your package. Wait for the notice from USCIS and send the documents requested back to them. Your case is in the hands of an immigration officer so its just a matter of time until you get your approval.

Hi, On December 15, 2008, we also got an RFE Request for an Initial Evidence. They asked my fiance's Birth certificate, his divorce decree and our G-325A. We havent able to submit his birth certificate and his divorce decree. But G-325A we did able to send it but i dont know maybe they lost it.

I got the USCIS RFE letter home today, and it was the marriage certificate problem. It looks like i will need to get a different marriage certificate, since my certificate says "Deed of Marriage"

As per the RFE, they wont accept it - "It Noted that a deed of marriage is not sufficient proof."

To all,

I traveled to India and gotten the deed of marriage certificate corrected to the right marriage certificate. The local panchayat gave me so much of hard time and it took me like 3 days to finally get the certificate on hand. It appears that it usually takes about a month for most of the people, i then had to show them the urgency of why i needed it. Also i needed a few politicians involved to get everything in order. I received it before the 28th, thank god i got this before the new rule took place.

Last week on Feb 28th the rules got changed in Kerala. I was told that, if one doesn't register their marriage within 21 days [Church Marriage etc..] that it will take like 6months plus to get the certificate. For those who tries to get the certificate after 21 days - the whole process has to go through with so many different offices.

And Today i send RFE back to USCIS, with the correct marriage certificate and the certificate from church.

This is the same reason I had my rfe. Once corrected you'll have an approval on 12-14 days. Goodluck.

I got the same problem too.we filed for AP last december with all the requirements, then we got a mail from the USCIS last march 7 for RFE asking for my 2x2 photos. But im very sure that we sent it already. Sometimes they misplace or lost papers and that makes the case take longer than it should be.

You should have sent everything that they asked for. You have not mailed what they requested so maybe that is why it appears as if they "lost" your G325A. Not sending what they requested makes it appear as if you cannot prove what you have stated on your application. I hope that you have sent it in by now with a copy of the RFE letter they send to you. Everything is fine... i got the approval today!!
