Can I pursue CR-1/IR-1 if 129-F is already approved and NVC sent on its way to consulate?

Hi All,

I am wondering how are you K-3 people going to the CR-1/IR-1 route... I heard they are following LingChe's and James' Shortcut. But how?

Thanks,

M

They do it by simply doing it. The LingChe shortcuts are one good way to do it. See the Guides for CR1/IR1 for the steps in the process. Both K3 and CR1 travel the process independent of each other after petition approval.

It depends. If the NVC starts sending you the paperwork to process the CR1/IR1 visa even though your K3 case is at the embassy, you can delay the interview for that visa until you're done at the NVC for the other one. It's very doable, just play "dumb" with the K3 as long as you're paying all fees and sending all forms needed to the NVC.

NVC will send your k-3 papers to the consulate anyway. And the consulate will set an appointment for your interview when they get it. So if you want to get the CR1 instead, just don't worry about the K-3 for a while and focus on the CR1 route explained on the shortcuts. The petitioner will receive NVC papers for the CR1 at home and you can just follow the instructions and finish the process in NVC in about a month (using Ling Che's shortcuts, of course). However, if the K-3 interview date is coming and you don't have your CR1 finished yet, call the consulate and postpone the K-3 interview because if you don't show up it would mess up your whole process. So, once the CR1 process is finished at NVC, they will send the papers to the consulate and set a date for the CR1 interview. Then, you can call the consulate and try to change the K-3 interview for the CR1 inteview. This will probably save you some time.

What does your I-130 Approval Notice say? If your I-130 is being sent to the NVC, then you will be able to pursue the CR-1/IR-1. If it is being held for you to file Adjustment of Status in the US, then you will have to chose between K-3 and CR-1/IR-1. There are steps to get the CR-1/IR-1, but it will take longer. Hi all,

Actually its the I-129F, NVC says:

"The State Department's NVC has recently received an approved I-129F petition filed on behalf of you spouse. This letter is to let you know that within a week the petition will be forwarded to the visa-issuing post overseas that is reponsible for processing visa cases originating in the country where you were married..'

Which case number did you give her I-129F or I-130? The I-129F case has been sent to the embassy. The I-130 is still at NVC. If you decide to go forward with the I-130 (CR-1) then you pay the AOS fee now. If you decide to do the I-129F, then you pay the AOS fee closer to the interview.
