Visa denied.!? No reentry for 10 yrs

Timeline

My husband had his interview at the US Embassy in Juarez Mexico and it was denied and said he could not come back 10 yrs. At the interview they asked him who his co-sponsor is, where he lives, what my name is, where I was born, his address, which he answered all correctly. Then they asked him the first time he entered the US and how many times he entered, which he truthfully answered. He entered illegally 10 yrs ago and entered 3 different times then she said she was sorry but his visa was denied and could not come back for 10 yrs. Is there anything else I can do. I've been told I can apply for a work permit. Is this true? Should I talk to a lawyer? Please anyone help with suggestions. I am so upset with my government. I don't see how they can keep a family apart. We did everything by the books, We paid all that money, for what? My husband has never been in any kind of trouble. It was just a big slap in the face. Any suggestions of comments are welcome.

Hmm.. not sure of what you can do, even if he answered the questions truthfully, he did enter the US 'illegally' 10/yrs ago. I also think you should repost this in the Latin Region or have it move to the correct region, as you will probably get more help.

Since he has been banned for 10 years, MAYBE you can apply for a pardon, check with a lawyer.

Entering the US w/o the proper documentation and process is against the law and he did it, I know is hard but that's the way it is. When you are interviewed not just the fiancees visa but for the actual green card, they ask the same question and I believe if you answer "yes" they may deny you green card as well.

I think you were misinformed from the very beginning and were not ready for your husband's denial. Unfortunately, the CO was in the right for banning him for 10 years. He may be a good person, he may have a family, he may not have caused any trouble but the law says that anyone who's entered the US illegally is subject to a 10 year ban, and he did. He broke the law, plain and simple.

What you now need to do is hire a very good lawyer and see what can be done, apply for a pardon, show financial need due to the fact that he's stuck in Mexico, etc.

Please check your facts, illegal immigration is a misdemeanor, whether they turn it into a felony that's still to be decided.

He cannot be called a felony criminal if the crime is not a felony. FYI the term should be FELON, not felony criminal.

Indeed, it is NOT a felony. However, it is grounds for the 10 year ban he received; and justly so.

I do not know if there is a waiver/pardon for this. Your best bet is contacting an experienced immigration attorney.

Why do you ask if YOU can get a work permit? where? in Mexico? I highly doubt it. If you think the US system is crazy -which it is- I am sad to say the Mexican system svcks even more.

Sorry to hear about his ban. There are laws in place regarding EWI, and you did not know them b/f he went to the interview. That's the very unfortunate part. Don't give up hope, however. Please check out the immigrate2us.com website---lots of excellent info with regard to the waiver process and the 3-yr, 10-yr, and lifetime bans. There are experienced lawyers on that site that can be contacted as well. They charge a lot, from what I've read. If you do your own homework and read as much as possible, i think you'll have a better idea about how to proceed. It's difficult for all of us to be separated, and I'm sure more difficult for you after hearing this news. Try to hang tough and become informed.
